Using I864 joint sponsor- shes just changed jobs

Hello, ill be using a joint sponsor for the i864 as my fiancee has gone back to school and therefore doesnt meet the minimum income. Our joint sponsor, her sister, had a previous salary of usually 50k which varied slightly as earnings were based on comission.  

 

She has recently started a new job earning more than that but shes only been there not even a week.

 

My questions are,

Will there be any issues with this as shes only been there a week?

 

Can i submit the previous tax return transcripts from irs for years 2016-2018, that we used for the i134 as they are up to date?

 

For supporting evidence, do we need;

3 years tax return transcripts

6months of pay stubs

Employer letter confirming employment details

Bank statements for the last year

Proof of citizenship (birth certificate or passport)

Proof of citizenship or LPR status is a must however what financial documents she will provide will depend on what she fills out on her I864.

Is she using tax income or current employment income?

Does she need to use assets because her income didnt meet the guidelines?

There is no checklist of required documents because its based on the individual financial situation and what boxes are filled out in the financial section of their I864. Whatever boxes are filled out you will provide the specific financial documents that are outlined in the I864 instructions.

If not she cant use current employment income.

She'd use tax income. Tax income is proven by the most recent return Transcript.

Still not meet the guidelines with that?

Then she'll use assets. What document provided for that will depend on the asset.

Yeah she can prove income is stable through pay stubs and employment verification letter will verify salary amount, its well over the requirement. 

So i assume she'd use tax income then? If her current income is still quite new? And is the tax transcripts for 2016 to 2018 still okay to use from the i134? As they are what would be sent if we requested tax transcripts now?

 

And she wouldnt use assets as she doesnt have any.  

 

On the i864 shouldnt she use her current income figure though, as it is the most accurate and up to date?

Only most recent year is a requirement. Three years is optional for any Affidavit of Support.

Correct. 2019 has not been filed yet.

No, she cant as she doesnt have the evidence to back it up.

Just slightly more at this new one. Although one or two pay stubs may be from the most recent job. 

 

So just to be clear, i should put her current income as her previous income amount? As it was the salary her tax transcript for 2018 is based off?

No, she cant as she doesnt have the evidence to back it up.

Her job is too new. She doesnt have 6 months paystubs to back up the Employment Verification Letter for her current job. You cant use the old job (EVL or paystubs) as she is no longer employed there. 

Therefore you cant use her current employment income at all.

Youll input in Part 6 Qu 7 of her I864, her 2018 gross total tax income IF she filed taxes as single or married but filing separately. If she filed as married filing jointly you'll use her 2018 earnings statement(s) gross total amount.

Thanks for that information.  On the i864 part 6 qu 7 is "my current individual annual income is".   

So i should write what her 2018 gross total tax income was?  Which is what she got paid in her previous role during that year?

Sorry to keep asking questions but where do i find that exact figure? Is it on the tax transcripts?

Box 1 of all her earnings statements combined or gross total on her Return Transcript provided she did not file taxes with a spouse.
