Hello, I have some questions and I really need help: so I am a citizen and I am going to file I-130 for my mom and dad I understand I have to file one for each person and also I-864 one for each person as well; now my case is that I file taxes with my husband which I And using my income and his income; that’s why he will have to file I-864A one for each person as well! So I am filing the I-864 and I am confuse: 

 

Part 1 which one I have to choose I was thinking 1.a.

 

part 2. Information about the principal immigrant ( who I should list my mom?) 

 

Part 3. Information about the immigrants you are sponsoring not sure which one choose from 1 to 3 ? (Mom and dad are outside of the US and when they get approved they will come together) 

 

part 3 enter the number of immigrants you are sponsoring in this affidavit ? Do I need to list 2 (mom and dad )? Is confusing because I am filing a separated one for my dad

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

part 2. Information about the principal immigrant ( who I should list my mom?) it does not matter, you can choose your dad or mom as principal just make sure you add them both. you can add up to 5 family members.

 

Part 3. Information about the immigrants you are sponsoring not sure which one choose from 1 to 3 ? (Mom and dad are outside of the US and when they get approved they will come together) you will have to choose option 2 and fill out family members below. also doesn't matter where they live you most put their mailing and residence address and so on.

 

part 3 enter the number of immigrants you are sponsoring in this affidavit ? Do I need to list 2 (mom and dad )? Is confusing because I am filing a separated one for my dad you do not need to file separate. so yes you're sponsoring 2.

For Person 1, list the spouse again since this section also asks for DOB and country of birth. Then, list each of their children; as a daughter your info will also be in this section.

Please be aware that the above answers are NOT correct. IR 5 visa categories do not have principal and derivative immigrant beneficiaries. Each parents IR5 stands in its own.  

You must complete and submit an I864 and I 864a for each of them , separately. The household size for each one does not include the other parent, as each petition and visa application has only one beneficiary. 

For your father’s I864 and 864a, the household size is you + your spouse +your children and any other tax dependents + your father.  Do not add+1 for your mother on his 864 

For your mother , your household size is you + your spouse + your children and any other tax dependents+ your mother. Do not add +1 for your father on her 864

Since it's needed at NVC stage, OP will use the upcoming new version of I-864 and/or its variants. OP still hasn't filed the I-130 petitions.

Correct .. but the calculation of the household size won’t change, nor will the fact that IR5 visas do not allow derivatives

no problem. did you already sent out your package? let me know if you need more help, i filled out two cases both were approved with no delays. also if you haven't send your package yet and you planning to use household members or a joint sponsor, you can send i-864A right away with your i-130, you dont need to wait for NVC stage to summit this document. also you can provide proof of relationship right away do avoid an RFE even if they say photos/bona fides and supporting documents are only for interview you can send it with your i-130 package. Good Luck, and let us know how it goes!

My Brother petitioned our parents, Originally he will only be the sponsor as his income alone is enough but when we reached to the financial documentations, my brother and his wife were filing joint tax return so what we did is we've added her wife as joint sponsor. We filled the form I-864 each for my mom and dad from my brother and also had I-864a each for mom and dad from my sister only. But the principal sponsor is only my brother.

 

Part 1 which one I have to choose I was thinking 1.a. - - You are correct.

 

part 2. Information about the principal immigrant ( who I should list my mom?)  - Yes, write you mom's name is the principal immigran on Part 2. Also, on mailing address on Part 2 write your mom's current address outside the US where she currently lives.

 

Part 3. Information about the immigrants you are sponsoring not sure which one choose from 1 to 3 ? (Mom and dad are outside of the US and when they get approved they will come together).  If you write your mom's name on Part 2 then tick the part 3. No. 1 as Yes - You are sponsoring the principal immigrant named on Part 2.

 

Note: Based on our case. What we did was we prepared one I-864 form for my mom and seperate I-864 form for my dad.

On our case, we wrote 1 referring to each applicant. Because it was referring to the affidavit. Ex. the affidavit if for  my mom, we wrote 1 on Part 3 no. 29.
