Department of State Sent Case to USCIS For Review

Timeline

This is my current status on my K1 Visa, does anyone knows the next procedure( my fiance is from Pakistan) or how long it takes to case to be resolved. I know there is no time limit on this type of case. I am looking to see if anyone has better idea of the estimated time. Thank you!!

 

  • My fiance already had her interview on April 15th,2019. 
  • The case was put down to Administrative processing 
  • it came to NVC and then it was forwarded to USCIS for Review on September 6th,2019.

On September 6, 2019, the Department of State sent us your case, Receipt Number WAC***********, for review. We are reviewing it, and will notify you by mail when we are done. Please follow any instructions in the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

They say 180 days but the most likely action is no action and the petition will expire

    You may or may not received a letter from USCIS stating the K-1 has expired.  It will not be resolved.   Best bet would be to marry and file a CR1.   You need to figure out why they may have returned the case as if not resolved you may run into the same issues once it reaches the embassy.

Why was your previous K-1 denied?  What happened during the interview?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yes, this is what exactly happened. Now I am feeling like an idiot. Immigration system is a complete bummer!!

Do you have an idea of what would be my best action next. I am thinking of going back to Pakistan get married and re apply as my wife. Which is I-130. 

 

How should I go about the procedure. Please advise if possible. Thank you for your time.

Previous one was denied because I did not meet her and I applied for my fiancé. Interview went well but they did not keep her passport/and did not provide any suggestions or concerns, they put her in AP.

I know. this is what exactly what happened what you have just mentioned on top. They did not tell us what was the issue. I have reached out to the senator office and they asked USCIS behalf of me and found out that the case has been expired and USCIS no longer will handle the case.

Applying on the Fiance visa especially when you have not even met her is not going to go well in the interview anyway, hence why they didn't keep her passport. If they had approved it, they would've kept her passport even if they wanted to send it to AP.
