Finalizing AOS Forms - Few minor questsions

Hi All- I posted this topic at the beginning of the week and unfortunately didn't provide enough back-ground context. From there I did not receive any responses so I am trying again! If anyone has any feedback/advice I am very interested. This time I will provide the background!

 

 

Background:

  • Married my wife early August in the USA
  • She has been in the USA legally for 8 years
  • She has a current active H1-B visa with over 2 years left on it
  • Her H1-B has an active and current re-entry stamp (this is important for later)
  • We have lived together for about 3 years and have legal leases to prove it
  • We have been vacationing yearly since we started dating
  • We started dating over 4 years ago
  • She is currently employed in the USA
  • We will be having a wedding in China (Already married legally in the US)
  • We have an active US marriage license
  • We have shared bank accounts going back over 2 years
  • We have shared cell phone bill
  • We have shared Insurance

 

I have some questions below. One specific question I want to outline is that I don't think we need the travel document/advance parole. We do not intend to leave the country with the exception of our Chinese wedding in October. Her current re-entry stamp will allow her back into the country legally at that time. Following up on that question, can we file before we go to China or does that result in abandonment of application? All my research and the directions seem to indicate it should not result in abandonment because she can legally re-enter and has a valid stamp. However, once her current stamp expires (January next year) she will no longer be able to leave without advance parole. Please let me know if that understanding is correct!

 

Form I-765

 

Q. Page 3, Q26 - Student and Exchange Visitor Information System Number (if any)

She has a number from when she was an exchange student, but this number is no longer relevant, it was 6 or 7 years. Gut feeling is to add this number, but is that what they are looking for?

 

Q. N/A in all fields or just top field of each section not being used? We are typing so putting in all fields is not difficult

 

This form was really easy to fill out, hope that's how it is supposed to feel!

 

Form I-131

 

Reminder: We are already legally married in the US - She has a current valid legal re-entry stamp from the US consulate valid until January of 2020. We do not intend to leave the country until the application has been completely processed after the Chinese wedding

 

Q. We have a Chinese wedding planned for October and will be filing this before that date. According to this document if she files for this and leaves then she has "abandoned" the application. Should we still file this?

Q. We do not have any other planned outings, but there is a lot of information about how often and when we will be traveling for this, other than the already planned wedding we couldn't answer this information?

 

Are we able to file this one after we get back, even if everything else is mailed in by then if we even need it to begin?

 

Form I-864

 

Q. Page 4, Part 5 Q1-8 - Sponsor's Household Size

For this, we believe the correct number is 2 (her and myself). Box 1 (Number entered in part 3 item 29) is 1 and then Box 2 'Yourself' is 1. Does this sound correct?

 

Form I-130A

 

Q. Page 3 Part 3 Employment outside of America

She has never had employment outside of the US. It says if there is none to put additional information. Is it okay to put "Never worked outside of the U.S."?

Q. Page 6 Part 4 Q 21.a Names of Beneficiary's spouses

I am her first and only spouse, so I assume I simply put my information here. What do I put for Date Marriage Ended?

 

Q. Page 6 part 4 Q25.a Information About Beneficiary's Family

Do I put my information there again? Given it mentions spouse? Do we put her parents and brother? We have no kids

 

Q. Page 7 Part 4 Q48 Travel Document Number

She does not have a travel document that I am aware of, is this form I-131?

 

Q. Page 8 Part 4 Q61.a USCIS office

Are we able to choose the office, or is there a specific office based on location?

 

Q. Do I need to put anything on the additional info page if I am not using it?

 

Form I-485

 

Q. Page 4 Part 2 Q 3 Information About your Immigration Category

I assume we don't have this number, unless they want the old one from her H1-B

 

Q. Page 9 Part 8 Q1 General Eligibility and Inadmissibility Grounds

When it asks about organizations, what level is it talking about? She was part of clubs/organizations in school and professionally though her work here, do we list all of those?

 

 

My only other questions are:

 

  1. N/A in just top box of section or every box? This is for all forms
  2. This seemed a little easy, am I missing anything specifically related to the forms?
  3. Other than these forms I plan to provide the stuff from the list below, is there anything I am missing?
    1. IRS Transcript last 3 years
    2. Table of Contents
    3. Cover Sheet
    4. Copy of Birth Certificate
    5. Copies of our passport pictures
    6. Copy of our lease that proves we live together
    7. Copy of our join financial accounts
  4. In general, is there anything I am not seeing or missing?

Dont bother filing it as it will be denied anyway. Yes you can file it after you come back from your overseas wedding.

Household size is 2 if its just you and spouse.

Yes and list the ones you can remember like girl scouts, communist party, cooking club  blah blah blah
