Hey there!

 

i have some questions regarding my case status and estimated time 

 

I filed my I-130 (petition of alien relative, my dad is claiming me as his under 21 years of age son) on July 2017, i was 20 at that time. 

On June 2019 I received my I-797 notice of action stating that my case was approved, a month later I received an NVC letter with case number and ID.

 

My question is.

  1. I am 23 years at this moment, We send the I-130 when I was 20. Does my current age affect the process at all?
  2. Now that I received the NVC “welcome letter” (I assume that’s the one I received) is this the moment i need to pay the affidavit and do the 6 steps?
  3. After doing the 6 steps, and  assuming everything goes as planned, in how much time can I expect to Have the consular interview.
  4. after doing the consular interview, approximately how much time shall I wait to recieve the green card?
  5. what Visa category am I expecting to get? ( the majority of the cases here are fiancées, I am the son’s petitioner)

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Also can you clarify, is your father already an LPR and has received his greencard and now he is sponsoring you OR he is also currently applying and you are a derivative of his application?

 

What is your country of chargeability (nationality)?

Based on your dates it looks like you will no longer qualify for an F2A visa as your CSPA age is over 21. This means that you would now fall into the F2B category. Based on the latest bulletin you are looking at least at a 3 year wait for your priority date to become current. For F2B it is extremely important that you remain unmarried

 

Side note: I am not guaranteeing the above calculation is correct so make sure if you have any doubts to get a qualified legal consultation.

This calculation is incorrect. Visa bulletin current date should be 06/01/19. This is when his PD first became current in the VB.

 

4. Determining Age at Time of Visa Availability

In order to calculate an adjustment applicant’s CSPA age according to the formula above, the officer must first determine the age at time of visa availability.

In order for the immigrant visa to be considered available, two conditions must be met:

  • The petition must be approved; and

  • The visa must be available for the immigrant preference category and priority date. 

Therefore, the date the visa is considered available for family and employment-based preference applicants is the later of these two dates:

  • The date of petition approval; or

  • The first day of the month of the DOS Visa Bulletin that indicates availability for that immigrant preference category and priority date in the Final Action Dates chart. [25]

I’m not understanding these dates. The filing dates for the I-130 and the  “petition” should be the same thing, why are they 3 months apart?

What is the date on the i797 you received that says the petition was approved? Was that the June 2019 one? I also want to ensure there is no date confusion between American convention and other conventions in those numbers? (You say 23/07 then 06/01, is the 06/01 1 June or 6 January?)

Didn’t realized i messed up big time.. sorry about that. In latin america we use dd/mm/yyyy instead of mm/dd/yyyy

 

The dates below are written as MM/DD/YYYY

How come they received the petition 3 months after you filed it? It got lost in the mail or what 🤨

I still don’t understand why they received it 3 months later.  Not that it matters.  Please clarify what priority date is listed on the receipt notice.

Again, can you clarify whether the i797 received June 2019 is the one stating the petition was approved?

 

assuming PD is filing date and the i797 is the approval notice (and that weebee was correct about VB current date, I didn’t double check!) then you are protected by CSPA, with a CSPA age of 20 years 10 month on 06/01/19. Those are a lot of assumptions to confirm though.

I was not actually. Whoops 😥 June VB cutoff was July 15. His PD became current in July though when the VB became current. 

Now if only OP would clarify what's his actual PD 😛
