Visa and Passport Names

Hi, My fiancee and I are almost embassy stage. She is the beneficiary and legally divorced in the US. The I-129f has her maiden name and then married name as an alternate. 

 

In the Phillipines her annulment is close, but not done. She will likely not have annulment before interviewing. So the passport is still in the married name. 

 

Will the visa have the married name still on the passport? Or will it be the maiden name from the file? I'm concerned if there will be an issue later on how they match. Thank you for any advise....

Question?  Why is she completing the annulment process?   If divorced from a foreigner she could have completed the Recognition of Divorce.   (neither of which is required for the I-129F petition process, but is needed to re-claim her maiden name)

 

Embassy will follow the name listed in the I-129F.     Her passport is still her legal name.

She is divorced from a filipino who has US citizenship as well and resides there. I think she inquired on recognition of divorce, but the annulment process was started years before. After all that time invested in annulment, and it being by late stages, it wasn't a sure thing which would take longer to acquire. 

 

So if they follow name on I-129f and passport is different, do you think it will be questioned when arriving in the US? Will she have to show extra documents?

Ah, yes I would stay with the annulment if it has been in process for some time already.

 

I am not even sure how the embassy will react to the different names.  I have never bumped into this with the K-1 visa, I have seen it a few times with the IR/CR-1 visa and it wasn't an issue in that case.
