With the continuing mess that is Brexit, my US wife and I have decided to make plans and consider US Immigration. If Brexit doesnt sort itself out in the next few weeks then we intend applying around November/December/January. From December we will be married 2 years. My wife has been in UK with Biometric Residency Permit since June 2018. We intend to apply via US Embassy in London utilising the Direct Consular Filing process.

 

Having done some research it seems this is what must be done. Grateful for any info on this.

 

Our intended "Road Map" -

 

I – 130 ($535) Alien Spouse along with Copy of Marriage Certificate Proof of US citizenship (ie: Birth Certificate, Passport) copy of Proof of UK residency (ie: UK BRP Residency Permit) copy of Divorce papers

 

G -1145 E Notification Await Case Number

 

Apply for Police Certificate

 

Apply for Medical ($275)

 

Get Vacinations History from my GP

 

Produce list of former addresses

 

Send Forms DS-230 part 1 ($260) and DS-2001 (from US Govt website) advising Medical Appt has been requested.

 

Receive Medical Date and attend

 

Await Interview Date

 

DS-230 Part II I - 864 Affadavite of Support for USC recent tax return, wages slips, proof of employment) Original Birth Certificate AND copies both for myself and US Spouse Original Passports AND copies for both and joint sponsor (if applicable) Original marriage certificate AND copies Original Police certificate AND copies US passport size photo of myself Credit or debit card to pay the Police certificate Vaccination history from GP Passport (any Vaccinations required is £30 each – as I am just turned 60 years old, I understand from US website, I would need a maximum of 3 Vaccinations – flu vax, Td/Tdap, and Mumps, Measels Rubella)

 

I will be grateful for comments with regards accuracy of the details (process and costs) I have posted. Have I missed anything?

You apply directly to the USCIS field office in London.   Be aware that the office is slated for closure in the upcoming few months though no exact date has been announced though likely in the first quarter of 2020.  They stop accepting petitions about 2 to 3 months before the closing date

I see we're not the only ones tired of this brexit mess!

 

We've just had our I-130 approved and are waiting until our second anniversary to move, in order to get the unconditional green card. 

Note that you have a year after the I-130 is approved for follow-up steps, so getting that sorted sooner rather than later wouldn't hurt in light of the closing offices.

 

We found the I-130 quite simple. Remember to fill in N/A in all the empty fields, and follow the instructions at: https://uk.usembassy.gov/embassy-consulates/government-agencies/dhs/uscis/i130filing-html/

 

This form sums it up really nicely, and indicates the order to staple things in too:

For the passport photos, you can take your own and upload them to a service like https://www.epassportphoto.com. If you select "do it yourself" then you can just download the result, print it at boots, and save yourself a nice bunch of money. Just make sure you read the requirements.

Also, as a note here, you do not need to send DS-230, it is replaced by DS-260 online. 

Similarly, DS-2001 is not needed as you can book the interview and medical yourself. You will not receive a date from them, but will call them yourself.

Just note that although it says step 4 - schedule medical, you'll want to schedule your medical first, and then the interview. Leaving at least 5 work days between the two.
