Hello, 

 

I am currently filling out the I-129F form with my fiancé (he is US citizen) and I have a question I hope someone in here can help me find the answer to. 

We are creating the whole packet together and since I am going to visit him in the US in a couple of weeks, we have decided to finish up and mail it together when  get there. 

My question is, when filling out the form, we have to note if I am currently in the US. Should I type that I will be, since I will be when we mail it?

In that case, what am I supposed to type in as information where they ask for I-94? I am travelling on an ESTA and I don't recall getting any information about a form.

 

I hope someone can help us out.

I'm sorry, I'm just a little confused

No. The I-94 keeps track of your visits. No need for you to have it. But it's good for checking back dates and I used it as proof of my visits instead of passport stamps

Okay. But I was in the states for two years as an aupair. And I had one back then. Can I just use the same one and the same number they are asking for?

But the I94 will change when you make your next visit, so if you use the one from that time it will not be up-to-date.

I'm sorry but this is not much help. I don't understand what this form is and why I need it and as far as I can tell, I have to pay to get it.

You don't need it. It's just a helpful tool to get the dates right.

 

On that page, scroll a bit down. It's the third option

you dont have to attach the I-94 but you do need the information from it for #38 on the petition. its just a simple print out and shouldnt cost anything. it's free at the link listed above

 

my fiance and i applied while she was still in here in the US. we attached the I-94 along with a copy of a ticket showing her departure and typed this info out as well in our cover letter for the app so USCIS wouldnt think she was over staying her  visa (I see youre on ESTA but will probably be helpful to attach a copy of your departure ticket if you will be in the US while applying)

No, but you will use it as evidence of the one required meeting between you and your USC fiancé.  It is an electronic record of your entries into the US.  Btw, US immigration is not easy, fast or cheap and I strongly suggest you and your partner spend a bit of time reading up on K-1s here on VJ.

It sounds like you may be a little confused about what the I-94 is? It is not a form you need to fill out, it is done for you and nowadays it’s electronic and you don’t even get the tag in your passport anymore. Every time you enter/exit the U.S., on ESTA or when you have a visa, it will be recorded on the I-94 automatically. It dates back 5 years. On my I-94, it shows entries from both when I was a student and after, when I was traveling on ESTA. Two different passport were also used since my first one expired and I got a new one, it’s all still in there under my current passport number. Letspaintcookies already showed you where to find it, I would print that one when you are in the U.S. (so it also shows your last entry) and attach it as (one) proof of in person meeting. That’s what I did when my fiancé and I sent in our application this summer.
