I-130 APRIL filers with pending NOA1!!!!

Hi!

I filed I-130 for my wife on April 12 and haven't heard from them yet. See my post here:

I've put your post in my favorites and will be watching for any updates. I am debating over whether I should just file I-129F with evidence that I have filed I-130 (case number and status, check cashed, etc.) or if I should wait.

Hey all that want to file an I-129F for K-3 with no receipt for I-130 (797)

I just received my I-797 for the I-129F. It said that it will take 60-180 days for them to process it. I filed it without the I-797 from my I-130 since I did not have it yet. I sent a copy of my check (received from my bank) front and back (shows date cashed and case number of I-130) with the online status form. Im so :innocent: I was having a rough day at work and loosing hope yesterday. I didnt even check the mail, like I did daily cause I was so sad cause I am tired of people asking me about my husband. It is hard to maintain a relationship afar. But I know that all this time and effort and of course money will be worth it when he is here with me :) . Dont loose hope yall, you will make it through with your partner :innocent:

I am comtemplating the same route that you took. Filed my I-130 on April 12 and still waiting for NOA1. (My original post here) Please keep us posted on your progress. Many of us are in the same boat.

I filed my I-130 around the same time you did. And to this date I did not receive anything for it. But I filed my I-129F with proof (copy of check, case status online, USPS signature receipt and copy of I-130) and received the I-797 from Chicago within a week. I think that they would not send me the I-797 without verifying the I-130 in the CSC system. As long as Chicago is at least doing their job, Im happy, and hopefully they might somehow get Californ I A to speed up the process in order to get my pookie in soon. I know that people are afraid to take risks when it comes to immigration, but nowhere in the I-129F did I read about submitting the I-797 for the I-130 when you submit the I-129F. As long as you submitt proof, you should be good to go. And Chicago is really doing their job :thumbs:

What I mean by check too, is that you should (Im suggesting, but do this at your own will) provide a copy of your cashed check (which you can get through your bank) front and back (the back should have a stamp from USCIS with your case number on it, starts with 3 letters). I have online banking so like I was able to print it. I guessed my case number by registering online in the USCIS site. I could not make the last 2 numbers, but I guessed and saw one for the I-130 which I assumed was mine, and then confirmed it throught an infopass in Sacramento. They had my name and my husbands name in the system. So I printed that online form to and mailed that and sent a statement that it was confirmed through the field office in Sac Town.

Hi Tussie and KevFabi, I hope you both get your NOA1 for the I-130 soon. It is crazy!

btw, the timeline in VJ shows IR-1/CR-1 for both of you but since you are doing a K-3, you might want to update it. to do this, edit your timeline here http://www.visajourney.com/timeline/intro.php and change the visa type to K-3 and log out. Log back in and you will get more field for the I-129F to populate

Am in the same position as the rest in this thread, filed in lated April and still nothing, but called and confirmed my receipt # (from cashed check) was linked to my information/name etc. Anyone in this position and got their NOA2 but still havent got their NOA1 in the mail?

Also what does the "touched" noted by lots of signature status logs for others mean? I have an online account but it just says the same thing each time I log in? Where would I see this 'touched" indication... or how rather?

Hi Bacchha

"touched" means your file was looked at, or worked on or something like that. It's usually a good thing! You can see if you were 'touched' by looking at the box on your case account that says "last updated" - if the date changes, that's a 'touch'.

I received a message from Chicago for the I-129F petition for my husband that the case was fowarded to CSC. To this date I have not received any notice for my I-130. But I hope that when they receive the I-129F, they get on their toes and start working on my case. I am going to call them and send an email to USCIS on the 24th of June since it will be over 60 days since I have not received anything for the I-130. I know :unsure: the receipt for the I-129F states that it will take 60 to 180 days from 4June07 to process it.

Does anyone know why Chicago would send the I-129F to California? Is it because my I-130 is in California (to be filed with maybe)? Thank you.

Hi Tussie,

The Chicago center is just a lock box with mail forwarding service. I think they only print NOA1 there and forward to other centers. I am glad you are not having any problems with submitting the I-129F without the I-130 NOA1. USCIS customer service told me not to do that. Please keep us informed of your progress.

By the way, when did you get the I-129F in the mail?

Hello April and May I-130 filers (F)

Did anyone one who sent out I-130.. and had their check cashed..and viewed case status online... and after doubled or tripled wait time (compared to other timeline statistics for I-130 NOA1).. finally receive their NOA1 in the mail?? I sent mine to TSC (May 9..rcvd May 15) and it was transferred to CSC (acknowled that they recvd it June 5.. and sent NOA1..uhuh..right ;) ) Im not sure.. but it really seems like petitions sent to TSC, then transferred to CSC are having to wait extra long. I'm feeling a bit slighted here..hmmmmmmm... Oh God help us. Oh God help send out the army of angels to get our notices to us.. :help: soon. I'm trying really hard to not get depressed. Also tryin to utilize my time with other things..but everything links me to my husband and our future.. (at times an emotional rollercoaster). Oh well.. I hope to hear of any updates.. insights.. infos.. vents.. prayers..etc.. Alhumdulilah!!!!

Hello, I have a question, to check on my case if they have touched it, I must open up an account. Its written there if you have 2 than they cancel one. I am afraid to open up an account maybe than they cancel the account with my lawyer, or does the lawyer has a different one.I like to find out and dont wanna mess. Its more importend for me that the lawyer gets the infos. By the way, I am also a March filer and wait. Thanks for the help.

Hi all,

I don't know if things have changed much since I filed my case last year, but it took them more than 3 months to approve my I-130. You can see that in my timeline. I know it's not always easy, but hang in there.

Fabi, why are you filing for the I-129? Do you really think it's necessary? CR1 visas are much better than K3, when you get here you can already work and go on with your life, and with the K3 you still have to file for removal of conditions and go for an interview at the consulate and another one at the USCIS office, wait for greencard approval, etc. I know that the K3 might be a little bit quicker, but in my opinion the CR1 is worth the wait. Of course, I didn't file for a K3, so I can only tell you that from what I've heard from other people. The only advantage is that you'll probably be able to move to the US a month or so earlier, but then will have to wait 3-8 months to get your greencard, etc... Anyways, if you need more info, please PM me.

Make sure you have the I-130 case number before you file I-129F. It should be on the back of the check. Looking at your timeline, you should have filed I-129F long time ago. I regreted why I waited so long but it was worthless - if it does not arrive in 45 days, it will never arrive. The only NOA1 that I received for my I-130 is one that I requested by calling them and they said that they mailed a duplicate - that was received after waiting for another month. They are extremely backlogged over at California Service Center.

On my I-129F, I included these proofs that applied for I-130:

1. Print out of case status from USCIS.gov site (This case only be done if you know your I-130 case number)

2. Request your bank to send you official print out (or original) check for I-130 fee.
