Short visit to 'activate' green card- permissible?

Hi all

 

Apologies I know this has been asked before but cannot find it when searching.

 

DCF in london.

 

One option I am considering is to receive my IR-1 visa, travel to US for a week before the visa expires (thus 'activating' my green card and having it and my SSN start the production process), then return to the UK for up to 3 months to tie up loose ends before returning to US indefinitely. My USC wife and kids would make the same trips. 

 

Would this be permissible?

As far as I know, when you enter CBP with a CR-1 visa in your passport, they will stamp it with I-551 stamp that serves as temporary LPR status until your GC arrives. I don't see why you couldn't leave again shortly after that. You just may face more scrutiny at the border when returning.

Yes, no problem at all. It actually happens quite often because people have matters to resolve, properly to sell, belongings to ship, etc.

Not an issue for a 3 month trip to take care of matter. The endorsed visa (it is endorsed at first POE) acts as a green card for 1 year.

Sorry one more question- would it be an issue if I worked in the UK in that three month period, provided that I declare the income in my US tax return?

Yes

 

We entered march, activated, left early April, re-entered end of June no issues

Same reason, closing out loose ends

was gonna ask the same question, but thanks!

except my wife will be here a week, then leave for another 5 month.

 

But I've decided to go see her and come back here same time, that should solve the issue if we run in to anything.
