I-130 & K3 Process - Nebraska Center (Jamaican Spouse)

Hi,

I am excited about this website and I am glad that we are all here to support each other. So I got married in May 2019, filed my I-130 in June 2019, and my K3 in August 2019. I had no idea that I could file the K3 Visa until I did some research because I would have filed it sooner, but the immigration office told me that my I-130 would be processed/approved before the K3 visa. The K3 visa application was free so I did it anyway, so I guess I have nothing to lose. So with that being said, when I checked the processing times for the Nebraska Center for both the I-130 and K3... it says that the processing time is shorter for the K3 visa. Please provide your thoughts and opinions, thanks.

 

P.S. It would be even better to get comments from individuals that actually works at some of these processing centers 👍

There is virtually no chance of the K-3 being issued. It's an obsolete visa...I believe only 3 or 4 were issued this year.

That said, there is anecotal evidence that filing the I-129F for a K-3 may or may not result in the I-130 being processed sooner since the I-129F and I-130 are adjudicated together by policy.

Yes, that is what I heard... but I figured I would give it a try. It just doesn't make sense to get people's hopes up. I didn't know that the K3 was obsolete until I filed it and sent it for overnight shipment. Thanks for your reply.

No harm in trying. I was just stating that the K-3 visa itself almost certainly won't be issued.

I just wished they told people that, I am sure there are other people thinking that this is a faster process, because that is what I thought. I just need to have a lot of patience and visit with him as often as I can until then.

USCIS staff are prohibited from providing legal advice...they can only provide input on what is available. Unless Congress changes the law to eliminate the K-3/K-4 visas, they remain on the books. The purpose of the K-3 visa came about to speed up the reunification of spouses since I-130s were taking 2-3+ years at the time. Since the I-130 is taking a year or less in most cases now, the K-3 no longer makes sense and policy was changed to adjudicate both petitions together.

The K3 visa isn’t just a faster version of the CR1 (setting aside its obsolescence).  I’d be careful of getting what I wished for.

 

The K3 Is a nonimmigrant visa and so you lose all the benefits of being married to a USC as there are more perks coming in on CR1 visa than a K1.

 

There’s no work authorization and you have to adjust status which is not free and delays everything.  Getting your spouse here sooner sounds great until they get here and can’t work study or drive for several months.  It can kill relationships and make them doubt if they did the right thing. They lose independence and you gain financial stress.  Good riddance to the K3 I say.

Doing even some cursory reading would show that it is obsolete.  And, if you only got married in May, why did you not do a K-1.....?   Effects are same as K-3 in practice.

I know a couple workers and an IO.

Thanks for the update, I guess I was just trying to find a faster way. I also think that the estimated processing times on the USCIS website is inaccurate. I have seen the dates fluctuate back and fourth... and I wonder the processing times are based on incomplete paperwork.
