We just found out that my husbands AOS application was denied and we have no idea why. We received a notice stating that on 3/29/07 a notice was sent out to us but was returned undeliverable by the post office. Now we are past the 30 day appeal time and don't know what is going to happen. We have an infopass appointment for tomorrow - we'll see what happens.

I have phone records from all the times we've called to see what was going on with our case and all they told us was just to wait. We moved on 4/1/07 and even called the USCIS customer service line on the DAY they just happened to finally send us something and now I'm afraid of what will happen. Between the post office repeatedly sending our documents (and other mail) back undeliverable, and all the typo's on the paperwork we received back from the USCIS, it seems our case was doomed from the start.

I don't know what to do next! Has anyone else had similar problems with receiving documentation from the USCIS and getting denied? Please, any advise is appreciated! :(

I know of someone who had the same problem. Her interview appointment was never mailed to her and her case was denied. She contacted the Congressman and he fixed that problem!

*Filed for K1 Visa on 4/4/06

*NOA1 - 7/6/06

*I-129F NOA2 Approved - 9/14/06

*Came to see me Thanksgiving week in Nov. 2006

*Date of US Entry (POE Chicago)- 3/5/07

AOS (My case was expedited due to husband going to Iraq):

*Filed for AOS - 4/20/07

*Found out in the beginning of June that husband is going to Iraq

*NOA for I-485 - 6/11/07

*Made Infopass appointment to get case expedited due to deployment (Infopass appt 6/12/07)

*Biometrics - 7/7/07

*Interview date - 7/11/07

*I-485 Aprroval date- 7/11/07

*Green Card Received- 7/19/07

Removal of Conditions:

*Filed petition to remove conditions on 6/9/09

*NOA- 6/15/09

*Biometrics Appt. in Birmingham - 8/6/09

*Lifting of Conditions Approval Date - 10/22/09

*Waiting for Green Card!

Had our daughter on 4/4/08 and have another baby due 11/19/09!!!

I am so terrible sorry for you gays. But I don't think its final decision for you, in worse case you will have to start this all over again. When you changed address, did you send form to USCIS?

08/04/2006 - NOA1

08/28/2006 - NOA2 - approved

09/01/2006 - NVC - approved

09/07/2006 - Warsaw embassy sent packet 3 (damn post services, never received any)

09/18/2006 - packet 3 sent (Nothing fails)

09/27 - received packet 4

10/10 - medical exam

10/19 - INTERVIEW!

10/20 - received visa

11/7 - arrived in USA, POE YFK

1/19 - Married

02/23/2007 - Civil Surgeon (checked just vaccines for $ 25)

05/04/2007 - AOS package sent to Chicago

05/11/2007 - NOA1

05/15/2007 - NOA2 - ASC appointment letter about biometrics

05/24/2007 - RFE about tax forms w-2 and 1099!!!

06/05/2007 - Biometrics

21/06/2007 - NOA3 - Transfered to California

10/07/2007 - AOS approved, card production ordered!!!

19/07/2007 - Half year marriage anniversary - GC arrives!!!

07/08/2009 - Package sent (My cover letter 40 peaces of evidence)

07/14/2009 - check was cashed

07/10/2009 - NOA 1 received, GK extended for a year

07/17/2009 - received biometrics letter with my case number

08/06/2009 - scheduled biometrics appointment

11/16/2009 - approval

12/01/2009 - touched - card production ordered

2/26/2010 - got ten year card

I dont know if you saw my reply to you on your other post but you can contact your congressman. let him know what happened and he will more than likely be able to help you.

We had a mail problem as well. I bet your letter was your appointment letter and you missed it. When we found out everything was undeliverable we made an infopass appt ASAP and were able to have everything faxed to the Los Angeles office from Missouri.

That really sucks.

That's my worst fear in this process... getting denied because I didn't receive the interview letter or RFE letter (and we all know that online status updates are not accurate either).

Good luck at the infopass and hopefully your senator/congressperson can help you out!

I would reccomend to anyone who has anything returned as undeliverable to make an infopass appointment as soon as possible to find out what was sent and to verify your address and either have the notice re sent or get it at the infopass appointment.

It sounds like your interview letter was never received by you and they denied your AOS for not attending. :( I'm no expert, but I have a feeling that you might need to refile the AOS application. :(
