Divorce and Immigration

My husband and I have been married for 2 1/2 years but we have been struggling lately and I fear he may push for divorce. I am hoping we can work toward reconciliation and attend counseling sessions together because I love him more than anything and don’t want to lose him however, if he has his mind made up I won’t have a choice. 

 

We submitted our ROC paperwork 7/1/19 so obviously it will be pending for a while however, I was wondering what the ramifications of abandoning the application would be? If my marriage fails here, I am going to return to Canada. I was wondering how it will affect my future travels to the USA if I ever want to go on family vacations or anything? Does anyone know? Can I cancel my application and tell them I am getting a divorce and returning to Canada? 

 

I am terrified, I am alone and I am afraid I am going to lose the love of my life. I am hoping that in losing him (and the first home we recently purchased, our cars and our four cats) I don’t also lose the right to travel to the USA. 

 

And to answer anyone’s questions in advance... Without him, I am not interested in US residency or citizenship. If he leaves me I do not want to continue the immigration process. I went through this for him and without him it means nothing.

Filed: Timeline

At any point (including during the ROC process) you can leave the US and surrender your GC- There is a form you use for that. Once you surrender your GC you should be allowed the same tourist privileges as other Canadians. (providing you never overstayed/no criminal record issues)
