In a bind... has anyone tried using a photo (instead of a photocopy) of their I-797 NOA2?

Timeline

We had to do this with our NOA1 because we forgot to make a photocopy and couldn't find the original document.  We just submitted our AOS paperwork last month so we haven't gotten an RFE but it probably hasn't even been looked at.  Just wanted you to know that you are not alone!

Interesting, thanks for the reply!  Why did you have to send in a copy of your NOA1? Isn't that just the notice of receipt of application that you get a few days after sending in the original I-129F?

I think we just did it for extra measure and then realized we didn't need to send the NOA1 later.

Thanks! Just clarifying that you meant for AOS and were not referring to the embassy interview.

That's fine.

You could also scan a copy of the actual approved I129F petition that may have (or not) been returned to you in packet 3 from your embassy.

Thanks for the feedback! What should be in packet 3? Is that the packet we received when they sent back her passport with the visa inside?

In fact there are two choices:

Option 1) Print and send the photo of the I-797, and hope it flies and we never receive an RFE requiring option 2, or

Option 2) Submit an I-824 ($465) to request a duplicate I-797 approval notice

Packet 3 is issued by some embassies only. It is the informational packet that allows the K1 beneficiary to proceed with scheduling the interview at their embassy. Some embassies will return a copy of the complete I129F petition with P3. On the front page of will be stamped approved. You could use a copy of that in lieu of the Noa2 approval notice.

I824 has a processing time of 8 to 13 months so that's not really a viable option if you need to file AOS within 90 days to continue to have authorized stay in the US.
