Have you guys seen this? It is proposed that limits on visa be put in place for parents and spouses...

Other Changes to the Immigration System:

  • Spouses and minor children of U.S. citizens and permanent residents would be eligible for green cards based purely on their family connections, but other relatives such as adult children and siblings would not.
  • Apply new limits to U.S. citizens seeking to bring foreign-born parents into the country.
  • Visas for parents of U.S. citizens would be capped annually at 40,000 and those for spouses and children at 87,000.

it turns out the spouses 87000 limitation is for permanent residents while parents 40000 limitaiton is for citizens. so the article above is not correct.

© PREFERENCE CATEGORIES." Section 203(a) of the Immigration and Nationality Act (8 U.S.C. 1153(a)) is amended:

(1) By striking paragraph (1) and inserting the following:"(1) Parents of a citizen of the United States if the citizen is at least 21 years of age. Qualified immigrants who are the parents of a citizen of the United States where the citizen is at least 21 years of age shall be allocated visas in a number not to exceed 40,000, plus any visas not required for the classes specified in paragraph (3), or".

(2) By striking paragraph (2) and inserting the following:"(2) Spouses or children of an alien lawfully admitted for permanent residence or a national. Qualified immigrants who are the spouses or children of an alien lawfully admitted for permanent residence or a noncitizen national of the United States as defined in section 101(a)(22)(B) of this Act who is resident in the United States shall be allocated visas in a number not to exceed 87,000, plus any visas not required for the class specified in paragraph (1)"

I can confirm that the article says nothing of the kind. What is quoted is the only part of the article that uses the word "spouses" and it doesn't say a word about any limits. The OP misunderstood what was written.

This just in on Yahoo news (june 7, 07) ;

Sen. Hillary R. Clinton, D-N.Y., fell short in her bid to remove limits on visas for the spouses and minor children of immigrants with permanent resident status.

Spouses and minor children of GC holders who had to endure years of wait before being united with their spouse/parent in US,

had their hopes pinned on Sen Clinton who was pushing for them to be included under UNLIMITED category.

Seems she did not succeed.

I can confirm that the article says nothing of the kind. What is quoted is the only part of the article that uses the word "spouses" and it doesn't say a word about any limits. The OP misunderstood what was written.

sorry, i just came across this article today.

Does this mean that there WILL BE a cap on spouse visas even for US citizens? i.e only 87,000 spouse visa's will be issued per year with the new reform? or does this cover only permanent cresidents..

Based on the www.usimmigrationsupport.org website, approx 450,000 Americans marry foreign spouses a year. Assuming that most would want to be with their spouses in the US ( i.e 450,000 = 100%) 87,000 visas per year is only 20% of the demand. How can this be possible?

Why are they seperating loving couples? Do we have to apart for 5 years or more assuming that they get to the end of the 450,000 pile??If i had a choice , i would be happier for my husband (the USC) to come to my country to live. It would be a less painful process for the both of us. But he has responsibilities there that he cannot leave behind (namely his 2 daughters).

It saddens me to hear that this cap is being proposed. I will not be surprised if the stress of waiting and waiting and unable to get on with lives will affect these relationships tremendously. I wonder if the USCIS and the immigration system can emphatize with how hard is is to be seperated from our husbands or wives, not be able to have dinner together, or read the papers together and just be together.

What sort of relationship can you have when you have to live your lives seperately for that long? I have heard of some VJ's that do not even dare to visit their loved ones in the fear of getting turned away at the POE.

I hope that they will review this cap and come up with something that makes a lot more sense!

I do not understand why they keep worrying about all the people doing things the right way and filing paper working and paying our fee’s when they should be fixing the 15 million that are illegally here now. It looks like to me that they want to give them a pass and start clamping down on doing things they feel are the right way in the future. As usual all us U.S. tax paying citizens have to pay pay pay again in more ways than one.

sigh..I never expected the waiting to be this difficult . Cassie, if i had to do it all over again - trust me, i would have gone for the K1.

I am not sure how many marry in the US using a fiance's visa. Are they (USCIS & immigration) assuming that 80% marry their spouses in the US using the fiance visa? As far as i know, there isn't a cap on the fiance visa. So they are very lucky. Its the ones who are married that seem to be doing most of the waiting at the moment...

just trying to make some sense out of all of this.

If you go and read the text of the bill that is being debated you will see that there is no mention of any cap on spouses only on parents....

And

As this is not even passed into law yet there is many hurdles it has to over come before that happens...

I have been doing a bit of research and that is what I saw.

Plus, most people do not realize that even this "debate" has been so new worthy, this is so far from becoming law, it is funny.

We still need to ensure that our elected representatives know what we do and do not support.

I am just interested in how they come to that statistic, and if they include K-1 visa marriages in the final total of 450,000. if they do, but frame the argument that so many USC's marry foriegn spouses and need a spousal visa too, it would be disingenuous. Just curious! :)

I am not sure how people are getting the idea that spousal visas are being capped for citizens when the article says nothing of the kind.
