I am a canadian citizen, who moved to the US when i was 14,my dad got a job here and he was on a work visa, by the time he got his green card i was over 21 so i was under a new category. By that time i was in college, and had gone abroad to teach. I came back to Canada in 2012 and went back to school and worked for  2 yrs and by then my visa for the US was approved-so i moved back here to my parents in 2014 when I became a perm resident. And just this past summer I became a US citizen...In 2016 I got married in London to a Pakistani national who was in the UK on a work visa. I was back and forth b/w london and Ny as i had a job and i filed for my spouse to come to the US..well i got denied last year 2018 because we filed based on our religious ceremony and not the civil..so i re filed this past Jan 2019, and I also applied to sponsor him in canada too. He had to go back to pakistan from the UK last year as they wouldnt re new his work visa, and since i was pregnant i had to go home. so now, we have an 11 month old baby which he has hardly seen. so i applied for him in both countries as we just want to be together asap.

im starting to worry as i haven't heard back from USCIS on whether they approved my i130, and some people in the Jan i 130 group have started to get approvals...Im also worried as I contacted someone from congress to inquire about my case and he asked to expedite it and, they refused as i dont have any need for it according to them. Ive made an account and it says it was last updated sept 4 when i called, and that someone will get back to me within 30 Days..sorry for this long post--just wondering if anyone has any insight on this and if they've applied to sponsor for 2 countries?

Thanks for the reply...It’s at California service center.. now that I’m a citizen  shouldn’t it be in another category

A couple things:

1) I believe you have to be proactive about changing the petition category if you become a USC. I don't think it happens automatically but maybe one of the seniors can confirm this.

2) The USCIS processing estimate for an I-130 at the Californian Service Center says "19.5 Months to 25.5 Months" for "Permanent resident filing for a spouse or child under 21" which seems kind of long. The VJ dates would probably more accurate. If take the VJ date you are still about 4 months away from an approval

3) One thing to keep in mind is based on threads here on VJ it seems common for applicants who are male and from Pakistan to go through a longer Administrative Processing time (in the months to year+ range).

4) I don't think your US petition would directly affect making a Canadian one. I am not familiar with the Canadian process but I would think they would have a similar requirement like the US for the petitioner to demonstrate they are domiciled or making efforts to domicile in the Canada. Have you looked into this? Even if your husband got residency in Canada he would still need to apply for a visa to enter the US which would be difficult with him having a USC spouse
