I am sorry to learn that you already got visa issue and cancelled after they found out the wedding. I am wondering what will happen if your husband didn't answer his phone or if he already gone to US with fiance visa. Same here we marry in church and the question never come up during interview. I still don't think they know about our wedding.

The previous K1 visa shouldn't be issue I guess. But they are going to be more scrutinize because they think it is fraud not telling them wedding while processing k1 visa. Just make sure that everything is in place.

This is yet another example of not to have these ceremonies. It simply is not worth it. Even if it is just a "church wedding" it could be still viewed as an official ceremony.

That’s so sad 😞, you’d think they’d of given u a waiver purely because you did the ceremony for compassionate reasons, without legal registration, particularly if you had supportive medical documents...

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

If you marry then enter the US on a K1 visa every single immigration benefit you ever get after including citizenship is jeopardized.  It is a deportable, unforgivable offense.

 

Of all immigration mistakes this one is the stupidest, most foolish on the list.

I'm glad they cancelled the visa while he was abroad. We didn't know that having a religious ceremony would be a problem. 🙁 we weren't legally registered at the time and that why we moved forward with the process thinking we could still do the legal registration in US.

People seem to forget, most of the civil employees working for the embassy, are local, they know the ins and outs of the country. They are the ones looking over documents, and making suggestions to the US embassy staff about the intending immigrant.

It is important to note that occurrences such as these, even if discovered after use of the K1 visa, can cause serious problems. If, for example, the spouse were to have attained citizenship and then it was later found that they were ineligible for the K1, this could in theory be grounds for removal — because they entered the US on fraudulent terms. I would hate for this to be the case for anyone :( 

 

You can be considered “too married” for a K1 visa, so it is strongly advised to never have any sort of marriage celebration before entering the US, since K1s require you to marry within the US.

 

I’m sure the additional time apart from your spouse is very hard, but consequences for these actions are not out of the question, even years down the line. And nobody on VJ will advise you to lie or conceal information from a consular officer — misrepresentation is fraudulent. I advise you to apply for a CR1/IR1 visa and follow the rules, although this is additional time apart at this point :(

Nice.  Lying for a K-1.  You hid the marriage certificate, claimed you were not married for the K-1 interview, and now you would like to use the marriage certificate for the CR-1.  Good luck.

The onus is on you to tell them that you were married and did not qualify for the K-1.  It's not a matter of they didn't ask, so we didn't tell them.  You lied by not disclosing material information.
