Not yet married, now confuse

i have a gf in the philippines and we have 2 kids but we are not married

i am a legal permanent resident (LPR) since august 2006

i need some advice whether i go back and marry her and petition them

or wait for my Citizenship by 2011 and petition her as my fiance?

Unless I am mistaken, the K1, K3, IR1/CR1 can only be filed by US citizens so you have to wait until you get citizenship and then you can petition them.

An LPR can petition for a Spouse (IR-1) but it gets a lower preference than a citizen of the USA, it probably will be faster to marry first and then file the petition than to wait until 2011 to file a K-1.

If I were you, I will marry with her right now, and get marriage certificate, and file for I-130 as spouse of LPR before July 30.

With that, you can save some money for I-130 filing, and get sooner priority date.

Then when you are eligible for Citizenship, file for N400.

If you receive naturalization certificate, you can upgrade your wife's case - I-130 should be approved by then, and forward to NVC for visa number availability -, which wll be pending at NVC at the moment.

I think that's fastest track I can think of.

even i think u should marry n petition her later on when u get your citizenship u can change your status
