I would need to go back and look, seemed messy and couldn't work out if it was just a fling from his perspective.

And let me add, the whole purpose of au pair besides minding the kids is learning English. It’s specifically mentioned when hiring that the family has to pay for that. WTH was she doing that two years later she still doesn’t have appropriate level of English? What sort of unskilled work does she think she can get under EB3 and with bad English?

Every path for immigration requires serious stacks of paperwork. Here is my AOS package before I sent it. Get ready for writers cramp... This of course can be avoided with a spousal visa, but don't worry, they make sure you have just as much paperwork to fill out.😁333381562_AOS.jpg.3a1795afd4300f5b8880c01cf8cc5486.jpg

It's not fraud when the relationship is legitimate,  partner

Given you already said Jeez to getting married, that you’d think there’d be a better way, and then joked about maybe getting married then...

I’d say irrespective of the legitimacy of the relationship... that the purpose of the marriage was for green card and authority to stay, not for the purpose of love only...your words, not ready for marriage yet, so yeah again fraud 🙄

best she go home like like she was meant to and apply for tourist or other form of visa before return

Is there any chance for a waiver?

There is no waiver for failing to make valid plans.

I foresee this thread being closed soon, but to the OP, I might suggest you have your girlfriend look into this as well, as it is her visa, her status, etc.

US immigration is complex, expensive and time-consuming.  It requires people to become educated on the processes, as one false step can have consequences ranging from minor delays to life-long bans.
