Hi,

 

My attorney hasn't been very communicative and I'm basically in the dark. Wanted to know if you guys think something is wrong.

 

I'm on an L1B visa (expiring in march 2020) and got my PERM approved in January (notice date on the I-797 is 01-30-2019).

Priority date on that I-797 says 01-31-2018.

 

Now, my attorney supposedly filed our i-485, i-765 and i-131 on 7/30.

So far neither of us has received any notifications, including any tracking number. 

The checks I sent to USCIS haven't been cashed either.

 

Should I be worried about this? My attorney just told me "something is wrong, I'll try to find out how long this is taking now" and then "we might need to file again but for now let's just wait some more".

 

From what I've heard before we should've gotten a notification within a week of filing. And by now we should've gotten the biometrics appointment. Right?

Is this an EB classification? Sounds like it,  the Lawyer would be acting for your Employer and the cheques would be issued by them?

That may be the complication where the Lawyer acts for the Employer and not knowing what that entails. Normally if nothing else they are pretty quick cashing the cheques.

Not sure what you mean. 

She cashed her check paying for the filing, but the ones paying for the actual filing haven't been cashed.

My question was more regarding the timeframe. Is it strange that they haven't cashed the checks 6 weeks after filing? or is it still within the expected time?

The checks should have been cashed already.

Is it possible that there is a regulation about requiring an applicant to foot the bill for an employer-sponsored visa?

According to my attorney the package arrived to USCIS on 8/5 and we still haven't gotten any notifications nor have the checks been cashed.

It's been exactly 7 weeks since they received the papers but we haven't gotten any confirmation number or anything.

 

Besides waiting or filing again, is there anything else we can do?

Send an inquiry with tracking number to lockboxsupport@uscis.dhs.gov,  they will research. A good attorney should know this

Hold on! When was your I-140 filed? Did you forget to list it here or had it been approved before the I-485 was mailed? Without a pending or approved I-140 your I-485 and other forms would be rejected. So hopefully this wasn't the case.

03/12/2016 Case received by Nebraska Service Center (NSC)
03/14/2016 Text notification received for I-140/I-485/I-765/I-131.

04/13/2016 Biometrics early walk-in completed.
04/15/2016 EAD/AP combo card received in mail.

12/01/2016 Prepared package for EAD/AP renewal (expires 04/09/2017)
12/23/2016 USCIS suddenly changes several forms, invalidating my EAD/AP renewal package (not yet sent)
12/27/2016 USCIS suddenly reforms the entire NIW criteria system, replacing a 20 years old one. Uncharted waters. 
01/07/2017 (Saturday!) EAD/AP renewal package with new forms received in Phoenix "reception desk"
01/17/2017 EAD/AP renewal case accepted; text/email with receipt numbers was received
01/30/2017 Law firm finally confirms that USCIS has suspended processing all EB2-NIW cases due to new criteria. 
02/23/2017 USCIS slowly starts adjudicating NIW cases again.
04/21/2017 Extended EAD/AP received in mail. Valid for 2 years. 
05/06/2017 Received a massive RFE on I-140 NIW case.
07/20/2017 RFE response received by USCIS (a very long response with 30 pages of docs)
09/14/2017 I-140 NIW approved!!! 
11/28/2017 RFE for new medical issued (plus another request re Supp J for employment which is clearly issued in error)

The i-140 was filed on 11/30/2018 and approved in January.

Okay then, that's good. Make sure the AZ address was the right one for your case. Give it another week and then ask the attorney to file again.
