I-134 Evidence

Hello!

 

Me fiancee has put together our affidavit of support for the K1 visa. I'm just wondering if the evidence that she has included is sufficient. 

 

The evidence she has included is:

 

  • A letter from her employer stating her salary, date she started, position held, and that its a full-time post. This letter is on company stationary and signed by a member of HR.
  • A signed letter from Wells Fargo, her bank, stating the amount in her savings and checking accounts and the date that both of them were opened.
  • A statement from Wells Fargo, that has been stamped and signed by the branch manager, stating all deposits in both saving and checking accounts over the past 12 months.

 

Does this community feel this is enough? Or should we include payslips too?

I forgot to mention that I also have her 2018 income tax return folder. But she was working/living in Japan so what she paid in income tax last year in the US wasn't over $20K.

Oh I see, then I would include couple of paystubs just in case. I would assume her income will be over the poverty limit this year right?

Yeah, her income is well over the 125% poverty guidelines for a household size of two. And she has over $18k in savings and assets without any debts. I'll ask her to send over some payslips/paystubs too. Thank you!

That poverty limit thing scares me a bit. I'm over 125% myself, but maybe not by a lot compared to my student loan debts. And that I-134 asks on the form your total debts, which I think is gonna look terrible on paper compared to my annual income. I have a master's and expect to get a higher paying job eventually. Do they take all this into consideration if your debt to income ratio doesn't look so pretty?

The UK community on VJ says the employer letter alone will do for London. The bank stuff is superfluous since her salary well exceeeds 100% of the poverty level. She doesn't need to list her assets since she has the salary. They don't even require a tax return from a K1 in London. If you want 2 proofs of her income, then add the payslips, but London has approved many on only an employer letter. The I-134 does not have a place to report student debt. If you are talking about Part 3, 8b, that is a real estate section for those who need to sponsor with assets for lack of enough salary. They need to know the house debt to determine the value of the real estate asset. If the property is worth $300,000 (8a) and the mortgage/debt is $280,000 (8b), then the value they give you for the asset is $20,000.

 

Do it over if you put student loan debt in the real estate section. Or credit card debt or auto loans. That is not asked for.

Ah okay, that's good. I don't know why but when I read it, the way it was worded made me think it was asking real estate AND all other debts. Thanks for the info!

I was surprised when you mentioned debt because that has never counted before. I looked up the form to see if it was new and if I had missed a change. I can see where it would confuse you.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
