Do I have to wait for ROC or can I just apply for N400?

Hi,

 

I filed I-751 in Sep 2018 and am still waiting for the ROC to be approved. (fingerprint reviewed in Nov 2018 and no update since then, vermont office)

I am eligible to apply for N400 but I am not sure if I can apply or not. I have seen some postings on combo interviews, but I am afraid to do so. 

 

Also do you have to apply for N400 while abroad? Even though the application is done online?

Yes, you can apply for naturalization while ROC is pending if you are otherwise eligible.

No, you certainly do not have to apply while abroad...most people apply while in the US.

Since  you applied for ROC and your status is still valid. Then you can file for Naturalization.

Define "While abroad". Living abroad or just physically abroad for a visit? Because you need to have the same USCIS field office jurisdiction for at least 90 days prior to filing the N-400.

So I have resided in NY state since early May this year. I moved to ny from a different state and changed the address around the same time. 

 

Since June, i have been abroad traveling. I am planning to go back to the states in October for few days and travel abroad gain for about 3 more Months. 

I was hoping to apply for n400 in oct when im physically in the States. 

 

I know, it might be just easier to apply for n400 after i finish traveling right? So prob like early next year...?

That is a lot of traveling. Have you looked into the requirements for n400 to make sure you are eligible?

The safest option is to wait until you return from the trips. That said, there is still a good argument of qualifying before that still, per https://www.uscis.gov/policy-manual/volume-12-part-d-chapter-6

6. Residence During Absences of Less than One Year

An applicant's residence during any absence abroad of less than one year will continue to be the state or service district where the applicant resided before departure. If the applicant returns to the same residence, he or she will have complied with the three-month jurisdictional residence requirement when at least three months have elapsed, including any part of the absence, from when the applicant first established that residence. [11] 

If the applicant establishes residence in a different state or service district from where he or she last resided, the applicant must reside three months at that new residence before applying in order to meet the three-month jurisdictional residence requirement.[12]

Yes, finish traveling, then apply. Our Naturalization case was scheduled to complete within 3 months from being accepted.
