How long process for i130 spouse visa immediate Relatives

Hi I submit my i130 for spouse visa and my wife she is under 21 how long process for approval and it’s almost 4 month so I have questions so anyone please help me out thanks so much

It takes a USC about 12-18 months to go from filing the I-130 to having a visa.

 

Your wife's age is irrelevant.

Are you a US citizen or are you a permanent resident/green card holder? What service center is your petition at? What country is your wife from? These all play a factor in how long it will take

Texas right now is processing at around 7-10 months for I-130 approval. After that is NVC which can take 3 months or more depending on how long it takes you to submit the documents and pay the fees. After that is the interview at the embassy and that solely depends on the embassy of how long that will take to get an interview. Only after the interview will your wife receive her visa, if she isn't put into administrative processing (which no one knows how long that takes, can be days, weeks, months, or years, so hope you do not get placed into AP)

The reason that visa type has less than 21 years listed is because there are different processing times for children of citizens who are under 21 years compared to children of citizens who are over 21 years. So Yes your wife is an immediate relative but not the type of immediate relative that this rule applies to.

Her age is irrelevant, doesn't affect processing time at all whether she is over or under 21. If you have been married for under 2 years she will be considered a "conditional resident" (CR1, 2 year green card) instead of an "immediate relative" (IR1 for those married 2+ years, 10 year green card). You still have some few more months before I-130 approval at Texas, then around at least 3 or more months at NVC. India also has a long backlog for interviews so don't expect to be done with the process any time soon.

You can open an inquiry when the priority date is greater than the case processing date on the USCIS website.

Even if they approved it by December. She won't be here in January. 

 

You're going to need to find patience. Otherwise you're going to go insane.

Even once the I130 is approved, you will have several months if not another year ahead of you. January is fine for you to go visit her in India. Remember, the I130 petition is only the tip of the iceburg, so to speak. You still have NVC and the embassy after that.
