Hey just a question regarding changing my wifes status from k3 visa to aos , the medical was done in london and everything went well and she is here in texas , i am going to file the AOS but what happens regarding the medical exam - does she need to go for another exam ? I have to look through the paperwork she brought over but she is positive that she did not get a copy of the medical papers etc ? if this is correct what do we have to do ?

Your medical from your K-3 visa is good for 1 year, you may only need to do the supplement for vaccinations if your AOS interview takes place before the year is up. The medical report from London was sent to USCIS along with all the other paperwork.

To do vaccination supplement you provide a copy of vaccination record to a civil surgeon for transfer to the supplement. (Fee $10-$40)

Sometimes having a copy of the I-485 instructions handy when visiting the doctor convinces them to just do the supplement.

my husband is here on K3 as well and his medical was taken at POE and when we filed for AOS all what we had was a supplement form- We submitted that but in the cover letter, I stated sealed envelope was taken at POE and it was fine. I hope this helps.

I'm in the same boat. When my wife asked the CPBI officer for a copy of the medical in order to file the AOS, the officer said all the paperwork will be mailed to the correct USCIS district. All we have is the vaccination records she initially took for her K3 medical. Can I just take this to a civil surgeon for the supplement?

Yep, that's all you'll need. If a copy of it was included with the original medical file, you maybe won't even need that, but most people do it anyway.

There is no need for another medicals here unless USCIS has chnaged the rules. The sealed envelope containing her medicals which she might have given to the officer at the first border of entry in the US.Else then, u may have to sick professional advice. Good luck.

Yes. take it to the civil surgeon for transfer of information onto the Supplemental form else they might not accept the vaccination card you brought from home nand that may delay ur approval. By the time of ur interview, ur medicals will be right infront of the interviewing officer. trust USCIS for that. God bless.

Hi guys - my husband arrived from India 4/17/07 on his K-3 Visa (Non-immigrant Spouse of US Citizen) and we filed the I-485 AOS on 5/26/07. What a confusing process...and we have read and followed every direction. My husband also turned in his yellow envelope at the JFK POE, so we were told we needed the I-693 Medical Report...another physical, immunizations ($340), x-ray, and blood test. After all that, we collected the remaining documents (our approved I-130 letter, I-864 Affidavit/ 2006 tax return, 2 passport photos, $395 fees, cover letter, I-693, Biographies (from I-130), etc.).

This past Friday, 6/8/07, instead of receiving the Receipt NOA1 for the I-485, we received a Rejection NOA :-( along with our cashiers check for $395, stating it was an "unnecessary fee or incorrect fee and no further action is necessary." ??? There were several errors on the NOA, including a new MSC number that was bringing Failure/Error messages on the USCIS case status website (case not found), and on the USCIS telephone system it stated "this Case Number cannot be found." The applicant was incorrectly listed as my name, rather than my husband's, and there was no Case Type (it was blank) but should have been I-485 AOS.

Has anyone out there ever received a Rejection Notice in response to I-485 for K-3 Spouse Visa, sending their check back, when it was confirmed the fee was correct? (we sent $395...$325 for I-485, and $70 for Biometrics Fingerprinting). Our I-130 has already been approved (Jan 2007), so were so confident everything would go well. Now we're stumped what to do. USCIS advised they've been experiencing some checks being sent back incorrectly to Applicants, so they said to send back the correct original check fee to Chicago, and it should processed alright. ? But we're not sure if the check will get lost next or disconnected from the case, etc.

Sounds like the just sent it back in error. It happens. Double check to make sure everything you sent them is correct, write another check and send it all back to them.

btw, your husband did not need to endure another medical exam, unless it was past a year since the last one.

In practice, the adjudicator might not consider the "date filed" but the date they are looking at the case. There is at least one case here where they filed within a year of the medical but got an RFE for a full medical when their case was actually looked at by the adjudicator indicating it had been more than one year.
