I (man, USA citizen) have been living in Ukraine for the last 3 years, I have a son with my fiance. My son and fiance need my presence and help in Ukraine a lot during the day to get through daily life.

I send my 129f package and  this week I received email. In it were my case number name of the service center. eMail also said  that I will be receiving NOA-1 soon.

My question is :

when should I go back to USA to establish domicile,  After receiving the NOA-1 or NOA-2?
Any suggestions are greatly appreciated.
Thank you for your time and effort.

USCIS processing for the I-129F can take upwards of 5 months.   Once the petition is approved it can take 6-8 weeks before NVC forwards the case file to the embassy.   You will need a U.S. residency for the visa process at the embassy.

If you are living together abroad, what sense is there in doing the K-1 visa? Why not get married already and file for a spousal visa. It’s much more beneficial for your wife.

it just happened this way. One of the reason for deciding on K-1 was , mandatory wait period of 1 year as a married couple before applying for a wife-visa.

Curious where you got this information from?  There is no mandatory wait period before applying.

if i get married in ukraine, it takes 1 year to be legally start residing in ukraine , that is the adjustment period for a usa citizen to be married and be legal in Ukraine . That one year is coming from there.

Below is extra stuff we needed to show for strong marriage. We thought fiance route is easier. image.thumb.png.635cef6d74f10b8737616f9c710b3973.png

There is no such requirement for a US spousal visa.   We got married in Ukraine and applied for a spousal visa a few days later.   I was there legally as a tourist under the 90/180 rule.

In your case, probably better to go back to USA no later then receipt of NOA2.
