Hi all.

So on my ds 260 I indicated that I don't know where the biological dad to my daughter is.(honestly I didn't know)

Now after the interview the consular gave me a yellow form and asked for consent letter  from the baby daddy or an order of sole custody.

So I did all I could last few days and to my shock the guy moved to USA few years ago.

So if he agrees to consent..

1.will he get it notarized in the usa?

2.will it not bring issues since i indicated on ds260 that I don't know where he is and now i know?

3.is it easier to go with order of sole custody.

Someone please help me reason out.

I would go with court order for full physical custody meaning child lives with you 

 

A court often awards sole physical custody to one parent so the child can stay in one household most of the time and attend the local school. The custodial parent physically takes care of the child a majority of the time and the non-custodial parent generally has scheduled visitation. Because the custodial parent must provide daily meals, transportation and housing a majority of the time, the non-custodial parent must share in those expenses. The non-custodial parent pays child support to the custodial parent, on behalf of the child.

Reason is the father may not give permission to bring the child here as you can file for child support money when you come

And if you come,  u need to do this / he should be supporting his child

With this action in many states the non custodial parent still has to pay support

 

If you ask him to give permission ,  he may say No as you can petition family court for support for the child after you arrive in the USA

and since he is not paying (you say didn't know where he was so I assume no money from him) ,  he may not like the idea that he will be obligated to be responsible in the USA

Thanks a lot for the insight..I guess I should just seek the order and be on the safer side.

I'm told the 221g is valid for one year so I still have time to get the order and send it back to the embassy.The consular told me when sending the order or the consent to also send our passports.so I really pray it will be well.

September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
