Timeline

Hello 

I'm from Tunisia and i'm on relationship with my US fiancé since 2015 ( Age gap 12 years ) , we just met in Tunis for one month and we are looking to apply for the K1 Visa to get married on the USA , my questions :

1- My fiancé going soon to get her divorce , so this is can denied to request ?

2- Its true that the real relationship has been started the day we met and we need to wait to apply for the K1? all the passed years aren't counted ?

3- What strong kind of evidence to need to provide

File for the K1 after the divorce is file and a certified copy is obtained.

They don't care when the relationship "started", just that you meet the requirements.

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Hello Sir i saw many cases in VJ that many pple get one visit and they got the K1 approval

Thanks for the reply , I readed somwher that we need to wait for a longtime to apply after the divorce or we will red flaged its true ?

You can file the day you have the certified divorce decree.  

 

You don't say what the ages are.  (We have a 27 year age gap).  Also cultural questions like different religions, childbearing  and  whether she has children are also red flags in the region.

 

Getting engaged on the first visit is better then getting married on the first visit.

 

In that region more visits you can have the better to offset the red flags.

You are awesome bud , Well im 33 years and she is 45 years old , we have the same religion , she lives alone @big apprt with a pup . I dkn if Tunisian is a red flags region or not ?

You should meet several times, in Tunisia, France, Spain, wherever you can meet. And keep joint photos, ticket stubs, hotel receipts, etc., when they have both your names on them or when they are clearly from the same date / time (e.g., two train tickets to same destination, same time, on same day). You are from one of the countries which is subject to extra scrutiny so you need very strong evidence and a lot of patience. Only five K-1s were approved in Tunis last month (https://travel.state.gov/content/travel/en/legal/visa-law0/visa-statistics/nonimmigrant-visa-statistics/monthly-nonimmigrant-visa-issuances.html) so consider getting married before applying.

Yes i just check the file you sent 5 k1 were approved but as i knew that not too much requests for the k1 visa here also you totally right that im coming from a country which the is subject need extra scruting but i almost have alot of evidence ( Pic together , hotel invoices , rings invoices , emails ,  facebook messages , letters from american close friends talking about our relation since 5 years ago , pics with family , gifts , love letters etc ...)  can you explain to me '' so consider getting married before applying ''  how we can marry before applying , we are looking for k1in the US to marry after the visa is approved

I never been arrested never been in jail , im good citizen and i respect my country laws

Unfortunately many of the best, most decent, and most upstanding citizens can get delayed by these extra security checks ("extreme vetting," "administrative processing," whatever you want to call them) so you can't be sure how long it will take for either visa type. I believe the marriage visa is the CR-1 and you would marry anywhere you could (Tunisia, France, etc.) and then apply as a married couple. In most high fraud countries or condor visa countries, those are approved in higher numbers than the K-1 visas and the green card received initially is for 10 years, not 2. Feel free to correct me if any of this information isn't correct, since this isn't our visa type.

You aren't wrong , but our plan is to try to the K1 then teh CR1 if not i will bring my fiance to my country my goal is to be with her whatever the way for the extra check im ready for it cuz i have nothing bad or to hide

If the couple has been married for less than 2 years when the foreign spouse enters the US, a 2 year conditional Green Card is issued.  If the couple has been married for 2 years or longer when the foreign spouse enters the US, then a 10 year Green Card is issued.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
