Adjustment of Status request in the 90 days

There is no requirement to file AOS before the I-94 expires.  You must marry or leave the US.  To continue to have legal status you file AOS.   You can get married anywhere in the US.  If being out of status is something you want to avoid, go get a civil ceremony someplace where you can get the certificate ASAP before your Big Time LA wedding.

You could have skipped all this nonsense by doing a spousal visa.

Yep, Vegas is only 5-6 hour away.

That's not what he said. His issue is that it takes almost 2 months to get the marriage certificate AFTER getting married here in L.A. So just to be able to file for AOS before the 90 days are up he had to move the wedding date to a much earlier date in order to get the certificate before the i-94 expires.

......and expected that to be explained on the USCIS website........hmm.

Just another reminder that the K1 might not be the best option. You do lose on the flexibility, to work, travel, and decide on the minute (or important) details of your wedding, such as being decide when you will get married to give enough notice to your guests.

Hello guys,

I am shocked to get to know that here in LA you get a marriage certificate (main requirement to put into the AOS request) after 6-8 weeks and so that means which I had to change my marriage date and set a new one at least 60 days before the 90th day because if my I-94 (90 days visa) is expired that means which I am overstaying illegally but if I send the AOS request before the 90th day then my status will be a legal pending status, is all of this true or is there something that I am missing?

I got married in Beverly Hills and we were also told that marriage certificate will be available after 6-8 weeks. However, we received ours in the mail just a little over 2 weeks after we got married. Hope this helps and good luck! 🍀

Absolutely! I just thought I’d give the OP some firsthand experience because I remember being so anxious about that timeframe as well thinking my I94 will expire before I can file AOS. Funny thing is my I94 expires 2/23/2019 and my AOS received date is 2/22/2019.

You must marry within the 90 days. You can do AOS anytime after this. You are technically "out of status" after 90 days. In my first K1 marriage we waited 6 months after marriage to do AOS. I don't know why we waited. It wasn't about finances or anything. It just didn't seem to to be important. We were approved without an interview even though we waited 6 months to file. But those were simpler times)))

But I don’t think he realizes he doesn’t have to get married in LA.

Temecula here (because we wanted an outdoor ceremony and San Diego county's page on downtown seemed like it was trying to talk you out of getting married there).

Orange County supposedly has some nice venues (and is probably the cheapest in SoCal, if that matters to you).

OP is unhappy with the lack of direction he got from USCIS but his real gripe should be with the time it takes to get his marriage certificate in LA.  In many locations it can be had the same day.  When we got married I hand carried the signed license to the county court house and got my official certificate same day.

Ya we did the same, hand carried the marriage license down to the county, couple hours later we were on our way to SSA with a certified copy and complete the application for the SSN.

The issue in L.A. is not the marriage certificate, it's the time it takes to record the marriage. It's not like we have been sitting around just waiting for a piece of paper, we have been waiting for our marriage to be recorded in the first place, which unfortunately can take up to 2 months. We were lucky, we only waited for 1 month. I happened to call the same day our marriage was recorded and went down to pick up my marriage certificate in person just an hour later (it was supposed to be sent to us but I didn't have time to wait).

We got married at the very same place as the marriage got recorded, so our marriage license never left the building in between our ceremony and the day the marriage was recorded.
