Not to mention they have actually pursued material misrep bans for false statements made at POE (separate from intent alone).

I think you need a lawyer simply because you and probably your spouse seem to be confused about how she got her, what was filed, what present status is blah blah. If she came on B1/B2 then she can adjust. If she entered with B1/B2 then she can adjust in the US outside VAWA ( which eligiblity she lost when she remarried).

 

BTW unless VAWA gets reauthorized it is a good as dead now.

Even if she entered the country on a tourist visa -which makes adjustment possible-, you mention letters from the ex-husband sent to the USCIS, accusing her of immigration fraud.

In my view, that will make everything way harder than it already is.
