APPROVED CASE GETS STUCK at USCIS. THEN WE RECEIVE THIS RESPONSE TO OUR SERVICE REQUEST. PLEASE HELP US INTERPRET IT.

Hi,

 

I have a question for you if you don't mind. My husband has been trying to get through a Tier-2 rep for about 4 times now after his first call, on August 8th and a Tier-1 put a service request for us. WE could only go that far.

 

He took a whole day off one day and waited for a Tier-2 to call him back only to find out that his call was never assigned to a tier-2 rep. Only yesterday, he was given the impression that he reached a Tier-2 rep, since he received a call back. She basically said no and told us to wait.  ISn't that what we are supposed to tell to Tier-2?  I mean my husband is a native speaker and a citizen by birth. So language cannot be an issue here. 

 

You seem to have solved your issue after reaching a tier-2 without mjuch fuss, and the issue seems very similar to ours.  What do we do wrong here we can't seem to figure out. Is it because yours is California center and ours  is Texas? Or, are we missing something here?

We've been trying to call a couple of times to, and sometimes the tier 1 rep, won't even let us speak to a supervisor.

It was not until my wife was very firm and said that tier 1 "you can't help us, I need to speak to a supervisor".

She basically just explained our situation to the supervisor, and she was really sorry for us and said she would reissue it. My wife is in California right now, and I can ask more in depth what she said to make it happen.

But as I understood it, she just explained the whole situation and that we are far apart from each other and all that stuff, which made the supervisor feel sorry for us. She also explained that we were first told to wait 90 days before USCIS could do anything about it, and that time has passed now and that they need to act or do something.

I am not sure if we were just lucky to reach a sensible supervisor or not.

So far our case has reached the NVC and we have confirmation from them that they received it, and we are awaiting case number at the moment.

What we did was to call right when the USCIS opened.

 

And I am the beneficiary living in Denmark right now, and our service center was Nebraska.

I am the beneficiary as well. My husband  tried to do the same, caling them the first thing in the morning. But he works at a place where cell phone use is prohibited and he can't keep asking for days off for making calls  that served us no use so far. So, from what i could discern, your service center is different, they say Texas is slammed. I am not sure those Tier-2 reps differ with service centers. Maybe, maybe not.

 

Another difference seems to me that tier-1's your wife talked to did not put a service request in your name with a confirmation number and all that. And, your wife asked for a "supervisor" instead of a tier-2 officer, so I presume there are supervisors above regular tier-2 officers. Her being firm and asking for a supervisor directly probably helped resolving the issue. Which is how it is supposed to be, anyways.

 

Excellent news after so many frustrating calls and waiting. It should be any minute that you receive your case number and IIN now. Almost there! Another obstacle run begins any minute, hope the rest of the process goes smooth for you. Best luck.

She spoke to a tier-2 rep (supervisor) and all she did was being firm with them, and saying that we waited the 90 days and after that they can reissue the case.

And they need to do it, because we waited the required 90 days, and now they need to do whats next.

She just said she was super firm and said they have to follow the rules.

Thank you. The one we talked to said she can't do that and we need to wait to hear from them. I gues we should try our luck again with another Tier-2 this time firmer.

I think it's worth a try to call again.

 

I am sorry to hear about your case, it's really horrible being stuck in their system.

Their process really sucks and if it was a private company all these phone operators would be laid off.

Well i am glad i found this thread. I too am stuck!

pd approval was june 27th 2019 and my case still has not been sent.

 

i have nvc research that sent their inquiry as well as my senator and i just sent my mail off to the congress man because this is crazy everyday i wake up hoping to see it sent to NVC. I have even hand written a letter directly to the Nebraska center. All this about 16 days ago. 

Im currently on my 10th week!! The 27th of this month would be 3 calender months. I hope my congressman can get them to push my case. 

When i get an update I will keep you people posted. I cant believe this.

I regret to welcome you on board. there are even more of us, unfortunately. Have you tried calling USCIS? That's a whole other level of frustration as you can imagine. But still worth a try. Which address? I think they also made those inquiry email addresses for service centers defunct sometime this year. I will fetch the relevant reference for you, not hundred percent sure..

The address that came from the approval. Uscis lincoln nebraska is where i sent my mail. Like an actual mail through my post office

 

calling uscis is a waste of time iv come to figure out that none of them are helpful. When i get to 90 days i will be calling again and speaking again with the tier 2 and then their supervisor. 

I need my case to move along just like everyone in here.

Yes, indeed. WE are on 111th day since approval and no dice with NVC or USCIS  so far. One tier-1 went as low as lying to us that she made the transfer and we should receive a call back, my husband had to wait all day for it, then the next rep said she never made a request for transfer for starters. And the only tier-2 person we could reach was not willing to help at all.

There used to be a two step inquiry process before reaching out to ombudsman , then turns out they made the service center inquiries defunct sometime in 2018.  ( https://www.dhs.gov/cis-ombudsman-update-getting-most-out-your-call-uscis-contact-center  ) I quote:

"If USCIS has not responded to your initial service request within 30 days, please email the service center that has jurisdiction over your case. Your follow-up should be addressed only to the service center which issued your receipt and is identified on the Form I-797 (Notice of Action).

California Service Center: csc-ncsc-followup@dhs.gov

Nebraska Service Center: ncscfollowup.nsc@dhs.gov

Texas Service Center: tsc.ncscfollowup@dhs.gov

Vermont Service Center: vsc.ncscfollowup@dhs.gov

If you do not receive a response within 21 days of contacting the service center, you may email the USCIS Headquarters Office of Service Center Operations at: SCOPSSCATA@dhs.gov and should receive a response in 10 days."

It really put a dent in my chest to hear that someone at 111 days still has no help. Everytime they ramble about the Bs 30-90 days i just cant believe people actually repeat that to people like us. 

 

At day 90 you should not be fiddling around like you are they should put you directly to a tier 2 sup. 

 

The last tier 2 i spoke to honesty told me he did not know why they take so long to send cases and that if i do reach 90 days he urges me to call back. When i do i will be rather forceful this time around because i have waited that 90 like they have been preaching. 

 

I hope you can get to call and get this ball moving..

Thank you for your kind words. I sure do hope so, too. My husband's name is Michael, too. :)  I can't believe it myself.  I mean, I lived in the US as F1 before, dealt with DMV etc.but this is a whole new level for us, too.  He is a native speaker, American citizen by birth, an all american boy so to speak, so language or prejudice cannot  be an issue here, either.  At least they are equal opportunity in that respect. hahah

Quick question, did you ever email NVC to look into your case? Did they never respond to you of the location of your petition?

Yes, twice actually. One as per suggestion of the NVC rep on the phone to the @nvcresearch address, then through the NVC website,  asking them to request USCIS to resend the case. They answered in approx three weeks both times, saying they can't find my case, they haven't received it and they keep looking. The second e-mail I got also stated that they got in contact with USCIS but received no reply to their inquiry. So, yes,  another dead end there for us, as well.
