I donot have anything in saving (we dont beleive in Saving accounts), donot own a home (we cannot buy home on interest basis), donot have any Stocks, CD deposits (dont beleive in them).

so what I have is my little tiny poor monthly check.. what you suggest me?

Thanks,

Here's the link to the poverty guidelines: http://www.uscis.gov/files/form/I-864P.pdf

The minimum for 2 people is $17,112 and for 3 is $21,462 (I only added this because it looks like you are expecting a baby :) )

If you meet the requirements then you do not need the info for the stocks/bonds other stuff. You would only need a letter from your employer refelcting the amount you make, tax returns and 6 months of pay stubs (that is my understanding from reading the forums). But you might want to check and see what is required in Pakistan as supporting documents for income.

If you do not, then you need a cosponsor who meets the poverty guidelines.

Hope this helps.

These are the 2007 Poverty Guidelines - depends on where you live and number of people in your particular household - the general rule used is 125% of the amount shown.

Also if you do use assets they only count as 1/3 the value of income.

Form I-864 Instructions page 9.

29. Total Value of Assets.

In order to qualify based on the value of your assets, the total value of your assets must equal at least five times the difference between your total household income and the current poverty guidelines for your household size. However,if you are a U.S. citizen and you are sponsoring your spouse or minor child, the total value of your assets must only be equal to at least three times the difference. If the intending immigrant is an alien orphan who will be adopted in the United States after the alien orphan acquires permanent residence, and who will, as a result, acquire citizenship under section 320 of the Act, the total value of your assets need only equal the difference.

Example of How to Use Assets: If you are petitioning for a parent and the poverty line for your household size is $22,062 and your current income is $18,062, the difference between your current income and the poverty line is $4,000. In order for assets to help you qualify, the combination of your assets, plus the assets of any household member who is signing Form I-864A, plus any available assets of the sponsored immigant, would have to equal five times this difference (5 x $4,000). Inthis case, you would meet the income requirements if the net value of the assets equaled at least $20,000.

http://www.uscis.gov/files/form/I-864_110106.pdf

The reason for the 1/5 and 1/3 values is the asset is considered to be a fixed value, and the minimum time of residence required for an LPR is 5 years for a non married immigrant, and 3 years for an immigrant married to a US citizen, at which point they could naturalize, and then the affidavit of support becomes invalid. So the fixed value asset needs to be divided by 5 or 3 years.

Consider the consulate applies the same financial requirements to I-134 as that are required for I-864

I have read over the asset instructions many times and i am still confused by them. If I were only using assets (because I am currently unemployed) do the total value of my assets need to be 5 times above the poverty level, 2 times above the poverty level or 3 times above the poverty level?

Quinn,

Don't bet on being able to use only assets to sponsor a K-visa applicant.

Really? So i need a co-sponser even though my liquid assets are above the 3xpoverty level? It's not like I don't plan on getting a job, it's just that I need to take the bar exam first and then once that has been taken I'll start looking for a job. Is there a way to explain that to the embassy? I certainly don't plan on being unemployed much longer than I have to, unfortunately, I have to be for the next two months.

Quinn,

I can't tell you whether you'll need somene else to sponsor your fiancee's visa or not. I can't tell you whether or not the consular officer processing her application will consider your assets, or how they'll evaluate your assets if they do consider them. All I can tell you is that the I-864 regulations do not apply, and so the consular offer may very well not apply them.

I can also tell you that the consular officer is likely to want a bird in the hand and may not accept your expectations for getting a job. Many applicants do not pass bar exams the first time. Or the second or third. And looking for a job does not mean that you'll be offered a job.
