For those of us that are waiting on or will be having the interview after today, how will the implementation of the new public charge rule affect us?

A very interesting question. USCIS hasn’t updated their page here:

https://www.uscis.gov/greencard/public-charge
to reflect the SCOTUS ruling. Ideally it’s going to be what it was in October, where only new applicants required to submit the I-944 form would be subject to the rule, and not retro-active . Making it retroactive back to Oct 15th would probably be a nightmare for all involved so hopefully it won’t come to that.

The cases are still proceeding in the lower courts, I’m guessing it will be back at SCOTUS at some point.

So, if we filed before then, it would not apply to us? Or is that also unknown until USCIS fully updates the website?

According to another thread response, it would not apply to those who already applied for AOS.

Hi guys,

Question! I have a job offer, I also have EAD and SSN. My SSN is still in my maiden name while my EAD is in married name, would that be a problem in employment if my SSN is not changed to married?

Nope, my wife got a job with her ED that has her married name, but social has her maiden name. She just brought her marriage certificate with her.

09/18/19: Package arrived at Chicago.

09/19/19: NOA 1: I-765

09/19/19: NOA 1: I-131

09/19/19: NOA 1: I-485

10/05/19: Received Biometrics appt letter in mail for 31 Oct.

10/31/19: Bio-metrics Appointment

11/05/19: Case changed to “Fingerprints have been Received” for I-485 & I-765

01/24/20: Status changed to: Case is Ready to Be Scheduled for An Interview

01/10/20: Status changed to: Interview Was Scheduled (For 485 only, 765 still says Fingerprints…

Anyone that is after the interview, was recommended for approval, didn't miss any paperwork but still waiting for the status to change to approval? I had my interview 2 weeks ago and I'm aware that there is some process to be done and they have 180 days to approve but I'm getting anxious.

me too. I'm assigned to Portland. Likely I won't get an interview scheduled in the next 6 months.

Awww, man.  We are waiting on hearing the YAY or NAY for our RFE submission.  We got confirmation they received it and are back working on our case.  But, nothing yet as far as approval or not.  Definitely getting anxious to be able to work and do things together. :(

Sorry another question about jobs. I am filling out W-4 for my employer. Am I right that I am a non-resident alien? Since I only have EAD but not GC?

My wife doesn’t recall that being asked on the form. Are you sure it’s the W-4?

Yeah I'm still waiting too 100 plus days after biometrics. But my local office is very backed up so I'm looking for the combo card at this point, but even that's taking longer than most. Story of my life though K1 was rough so why should AOS be any different. 😀
