Wow.  So even after proving his income was more than enough, they still want a co-sponsor?  What on earth is the legal basis for that?  Or is the situation that you are waiting to hear, after replying to the RFE, if they are satisfied with the income?

Thanks for sharing that--it's pretty astonishing and disturbing.

A typical RN salary is probably several times 125% of the FPL, which looks like $21,137 for a family of 2 per:

A copy of your individual Federal income tax return, including W-2s for the most recent tax year, or a statement and/or evidence describing why you were not required to file. Also include a copy of each and every Form 1099, Schedule, and any other evidence of reported income. You may submit this information for the most recent three tax years, pay stubs from the most recent six months, and/or a letter from your employer if you believe any of these items will help you qualify.

 

In our case, our attorney said we didn't need to include copies of 1099s alongside the irs.gov return transcript, since we met the income requirement without those, but we submitted everything else.

Of course, this attorney has been known to make mistakes.

We haven't heard anything since biometrics, but I hope they don't choose to ding us for that pointless requirement.

 

I'm curious if anyone has received RFEs for:

 

Lack of a second marriage cert. copy in the I-765 portion of the application. Spouse took my last name, so this is worrisome, as I can see it being a source of confusion if they split up the AoS package.

You'd think everything would be scanned into a database, but perhaps not?

Not listing the visa number in the 485 (though we sent a copy of the visa and of course we had the i-94 and PP data)

Yah i dont know whats there basis. But we don't have a choice 😅 We are yet to send our RFE... i’ll update you soon.

If you don't mind me asking, how much does he make? Because sometimes parts of the package gets lost and they have to send RFE. If they lose the tax return, the sponsor is automatically disqualified and they ask for a joint sponsor.

 

If your sponsor/husband is well above the poverty line, I would just send all the documents again to prove you don't need a joint sponsor.

Good point! But we’ll just send what they ask for just to be sure😅.. he earns 76k and for 2 household it’s more than enough... we sent everything except the form 1099 which we don't have. Did you include that form in your packet? They ask me to send my husbands w2,1099 and tax schedules and requires a co sponsor as well..

76k and it's not enough?!!! Waiting for my RFE as well then lol

😢 yeah maybe.. I made sure everything’s complete before sending our AOS packet and it’s so disappointing to know that they have lost or worse didnt  Even bother to check all our docs. But i just have to move on and  submit whatever they are asking 😂...
