Hello!

For anyone who was completed the new Public Charge form, a friend is having to re-submit his application, so the new form applies.  He is asking what he needs to fill out or do if he does not have the following yet:

-NO SSN

-NO health insurance

-NO license

And some other things he doesn't have because he has no SSN and, therefore, can't get these documents.

What can he do now?  Or would he fill out the form?

Background:

He submitted the AOS back in August 2019 and it got denied in April 2020.  Even though him and his spouse got a RFE and submitted the response, there were still some documents missing, so it got denied.

@Sarge2155 Do you know how the re-application process goes with something like this?  He has been in USA legally since December 2018, already married for a year and a half or so and came in on a K1 Jamaica-USA.

May 2019 - K1 interview scheduled and packet sent to embassy

June 2019 - K1 interview, approved, and moved to USA

August 2019 - Married

September 2019 - AOS/EAD/AP filed

October 2019 - Biometrics Appointment

January 2020 - AOS RFE for birth certificate received and sent back

February 2020 - EAD/AP approved and got the card

October 2020 - EAD/AP renewal filed

November 2020 - EAD/AP renewal approved and got the card - AOS interview date issued

December 2020 - AOS interview, approved, and GC received

September 2022 - ROC filed
June 2024 - Biometrics Reused
July 2024 - Approved (NO INTERVIEW) and GC received.

Yes he would have to submit a NEW application including the I-944 plus the fees. He got denied so that one is done.

Right. But, the I944 asks for a lot of information based on SSN that he doesn’t have, so he is wondering if that would affect the application. For example, he can’t provide health insurance proof because his spouse’s insurance won’t add him without a SSN. Would not submitting this proof increase his chances of denial? I am thinking it will, but I haven’t had to deal with any of that.

I have not dealt with the I-944 either as I filed before the deadline, but I do know the form is a monster to fill out. I would suggest  he get a VJ account and visit the March and April 2020 AOS threads everyone there has filed the I-944 and he can learn  a wealth of information there. Be advised the form is so difficult that several people have got rejected several times due to the form not being filled out correctly. Sorry I can't help on the I-944, I was determined to make the deadline so I could avoid just this.

@Fe.Ta any word on your interview yet? Should be any time now I suspect. Hopefully things will pick up now that some offices are opened again.
