You have timeline approximations on here from what people are filling out (which includes all sorts of stuff but is a pretty good idea) and then you have the official timelines from USCIC - https://egov.uscis.gov/processing-times/

Unfortunately no... not expecting peep really until Aug/Sept/Oct 2020... Was hoping we'd be moving back this summer but its looking like maybe next...  Hope you are all!

How much had all of y'all looked into the process before you applied for I-130? Just curious because while my husband and I had a general overview, we had no clue it would take this long to be approved (in general, not saying just for our September filing). 

 

I guess we came into this process with a bit of naivety and excitement. We figured we'd be finished and moving to the states shortly after my visa expires in March 2020. As we've read more and more cases on VJ and on Korean websites, we keep realizing just how wrong we were. I think that has made the waiting worse, originally coming in with different expectations. It's hard convincing my husband not to stress too much when I'm also low-key stressing.

Yes, its brutal.  I thought about a year, but having got stuck with Nebraska its tacking on another 6 months or so it seems.  Which is totally unfair.  Maybe we'll get lucky, I don't know.  It impacts a lot - especially with our kids and schools and jobs to consider, makes it hard to time everything.

 

What type of visa are you eventually applying for?

Yeah I get the timing thing. With my visa expiring, I can pick up a job for another year in South Korea, but I didn't originally plan on doing that so the job search in on. Plus, the house we currently live in is connected to my contract that ends early next year. So, yay! have to find a job and a new apartment! 

 

And yeah as a former military kid, it stinks to have to move mid-school year. 

 

And the visa for my spouse you mean? It will be CR-1 but who knows, by the time we get approved it might be IR-1.

Hi - yes then for your spouse.  I saw the K3 process on your timeline so wasn't sure.  I was considering filing the 129f it but its looking more and more like it won't do much.  The only thing maybe is I could chase earlier if I had the 129f filed oas the timelines listed are shorter there i guess.  As I'm already 3 months in I don't really think its worth it but I know nothing to lose there either really...   

 

Could you build a case for "Severe financial loss to a company or person" by having to find a new place/job etc?  What if you don't find a job?

I've heard ppl file I-129f after I130 to expedite the process. Basically they will deny your i129f and approve I130 soon after. But they said not sure it will work for IOE cases.

Ah yes, it's CR-1 but I did file the I-129F for K3. It was before people on here realized it wasn't a magical fix as much anymore. But pretty much everything for it we had already collected to file I-130 and since you don't have to pay fee again, it was just the cost of mailing it to the lockbox. So, figured why not? Even if it just sits there and amounts to nothing, I think it made me feel slightly better.

 

And unfortunatly, looking at the specifics for financial loss, they would probably tell me I could just move back to the States without my husband to find a job. Which, while I could, I'd rather stay in country and wait with him. I'm hoping I can pick up temporary work here and my husband will be working, so we will have to live off his salary and our savings.

 

Here's to hoping Nebraska people magically get their times sped up, even if by a bit *fingers crossed*

Thanks for ur reply. I’m the USC and my husband is the foreign beneficiary. He is currently in India. I stayed with him until September and then came back and applied for his I-130. After coming back, I found out I’m pregnant. Although I’m happy, I also feel stressed out bcuz he’s not here to go with me to all the appointments and more importantly, he won’t be here for my delivery. That’s why I was wondering if we could try to get him here on visiting visa for a month or so around my due date. However, I read that it’s difficult to get a visiting visa when you’re in the process for a spousal visa

Depends if the applicant, your husband, can show strong ties to his home country - which is what he would need to do anyways.  Cant hurt to try!  Congrats on the news and I do hope hes able to visit from time to time.  As long as he can get the visa and then when he visits also be able to show that he is planning to return back to India (round trip ticket, some rental or lease perhaps, or a note from employer saying hes on vacation etc).  Im sure its a rare occurence but the border agent can deny entry, even with visa, which would really put a damper on things (i think a 5 year ban but I am not sure)...

Congrats! well I remember seeing something on the official website about visiting the US while applying for spouse visa. There's a form for that I think. We're planning to go back to the US for Christmas and I will be traveling on my previous B1/B2 visa.

Thank you! He will definitely return back after his visit. But the 5 year ban really worries me. I definitely don’t want to take that risk.
