I dont know the inter workings of this on initial review and then how USCIS does their inter department handling. Just speculating. 

You are seeing January feburary filers get ahead of Oct Sept etc etc

I totally agree,

If someone's case thought to be fraudulent or anything fishy about it they transfer it to Vermont where the waiting time is over 17.5 months where you can't even file CASE OUTSIDE OF NORMAL PROCESSING TIME.

I did some research and found out that the longer processing time occurs only if the beneficiary is not from and an advanced country where it's hard to get information about the filer's spouse. 

I see January and February  approvals while August and September filers are still waiting.

I wonder if a spread sheet was drawn up if this would hold up. 

Its a shame you experience love and meet another from a different country and this has to be the case. USCIS becomes match makers? 

We all know how people are at that task.

I spoke with a Tier 2 for my case and they said it was still in Texas where I initially filed it. I couldn’t file an inquiry online due to an error on their end which the Tier 2 promptly submitted an inquiry on my behalf. The response came from Texas.

 

While your theory is totally possible in terms of Beneficiary’s country of origin, for me personally this theory wouldn’t apply. My wife is from Canada. We’ve also been together for 5 years prior to marriage, and both of us have no criminal records or legal issues of any sort. She works in tech, and I work in law enforcement.

 

I genuinely think there is some general disorder with their process.

 

Regardless of the reasoning, for those of us still waiting, I hope we get approvals soon.

There are things that make some cases more complicated than others. In one of my other groups, a person mentioned that the Tier 2 told them that it sometimes has to do with background checks on the petitioner. Someone with a previous divorce, a criminal record, or someone who has lived in many different states/countries may need more time and be less straightforward than other cases. It is possible that the country of the beneficiary may have something to do with it too, especially in countries with high fraud rates. 
 

We had a pretty early approval (April 7) and I’ve lived in 4 states, but only two within the last 5 years. good luck to everyone!

Yeah, some of that would make sense for certain countries. But then you have my husband and I in South Korea, a very developed nation, both never been married, no record of any kind. He's only lived in NZ and SK in his life. Yet here we are 8 months waiting. 

 

I put in inquiry they said they were forwarding to Texas, but still haven't received a reply (and sent it May 13th).

Right... My Australian wife and I have been married for 7 years and have 2 kids - we have lived in Hong Kong for those 7 years as well.  Not sure whats going on 😉

I also know a couple (husband: beneficiary / wife: Petitioner),
They also lived together in HK for many years, and they also waited for more than 250 days.

So I am also curious whether the place of application is also a factor judged by USCIS.

Filed at the stateside lockbox means it gets to one of a few different service centers.   The USCIS only determines that the petition is valid and does a background review on the petitioner.  If the petitioner is not been residing in the US then those checks can take longer.

I've been living abroad since 2008 in China and Hong Kong.  Maybe that's why...  But I have been maintaining domicile as well all this time, have properties there, filing taxes, bank accounts etc...

Timeline

Still waiting with PD 17th of September. Living in The Netherlands with my wife, so that may be a more complicating factor. Using the USCIS case tracker app, still see a lot of pending cases. Still hoping for approval before the 1 year mark as that is what we have been planning for since the beginning (got NOA1 from Nebraska).

yeah same, probably not moving to the US until next Summer now anyways... just tired of the waiting already but some things cant be rushed

That could be true, it would make some sense. But I also had 2 friends (US citizen and South African citizen) who were teachers here in South Korea for 2 years and before that lived abroad in Spain. They applied in Feb and already approved early May. So, there's also exceptions to that.

 

I feel like USCIS blindfolds their workers and makes them throw a dart at random dates on the wall to process that day.

Every case is unique with different attachments.   And just because USCIS receives cases in order they are not processed in order.  Each service center has its own processing time, each adjudicator process is his caseload at a different and background checks do not come back at the same rate.   It is like getting in the wrong line at the grocery store.

 

There is some evidence that online cases are processed faster now.

 

Two years ago we got our spousal visa in about 100 days.  It looks fast but then when you look at our timeline you see why.

Finally saw a date change on myUSCIS dashboard. I’m not hopeful that it means a ton, but it was nice to see a change. It now says May 26, 2020.

 

Last time we saw a date change was March 25, 2020.

It may somethings good though. I wish my case have some move like you. Where is your center and what is your PD?
