Freaking out!! Please help!!

Hello,

 

My husband and I recently sent in forms I-485, I-864, and I-765 together. I think I forgot to sign I-864 but I just cannot remember and for some stupid reason I didn't make a copy of the packet this time around.... Would they just notify us that something wasn't signed and let us resend it without having to pay again or will we have to redo it completely and send in another payment? Do you think I could call the bank and have them cancel the check and just redo the paperwork? I don't know what to do.. If they let us resend (just the form with the missing signature) without having to pay, i'm okay with that even if it just takes longer but I don't have another $1k to send right now so i'm very worried. I know it's my fault and up until now I've been very conscious of signing everything and making copies but I dropped the ball here... Please, any advice would be helpful!!! Thank you in advanced.

If the petitioner didn't sign the I-864, I guess they can issue a RFE as it's part of the I-485, not a standalone form.

 

If the I-485 or I-765 wasn't signed, it will be rejected. They will send the whole thing back including the payment.

Oh okay! I thought that we wouldn't even get the payment back but that's a relief! Thank you so much.

No, They can't have it both way. If they reject the filing for something like a missing signature or incomplete form filled out or some clerical thing like that, they don't take the payment. If they take the payment and accept the filing, they can only reject it on the merits.

Payment wise you have nothing to worry about. Either they accept your package and issue an RFE that you respond to, or they reject the whole package meaning they never cash the check.

Awesome! So if they reject it based on it being incomplete, can we refile right away?
