He should personally receive the paperwork needed to satisfy the RFE and send it off registered with signature required. This is something that you neve want to lose control over. It's your future. You have an investment here whereas the court clerk does not.

Sigh. I hope it is just something simple. 😭

It's always something simple. It's either a check box that was missed or additional evidence all of which you are capable of submitting. 99% of the case that reach the RFE stage are almost approved with the exception of the answer to the RFE. Answer that properly and your approval is on it's way. Your over thinking this process. Relax and take a deep breath. Trust the process.

That is how I feel too. I’m worried if the police refuse to give us the document the court will too. Is there a way this can be circumvented? If the police don’t and the court will would you just skip the inclusion of the arrest record and just submit the disposition from the court?

Either is fine. If you don't get a document request they state that in a letter and return with the RFE. Agents at USCIS have encountered this before so you're not the first.

My RFE asked me to provide police records and court records.  I provided the court records and a notarized affidavit detailing what happened. I did not provide police records though I did call the police and they told me they can give me a clearance document which I never went to get because I thought the court record & notarized affidavit was good enough. 

 

With the court records and notarized affidavit, my petition was approved and I received NOA2. 

 

If I were you, I agree with Greenbaum and would send the documents myself.  I'd probably get the court documents which I'm pretty sure he will be able to get and a notarized affidavit (I did mine online with an agent in Virginia).  Then send off.  

 

During the 2 months I was waiting, I read 30+ denial reports and don't see how this issue would put your petition in any jeopardy.

@Brazasian saw the update on the Case Tracker app. Then I checked on the website, and confirmed that we were indeed already approved. 😍

 

I signed up for updates on the USCIS website, and I did get an email of the approval. But I didn't see it until later. 😅

Thank you for your reply and Congratulations on your approval. I am really nervous as it has already been 110 days now and still waiting. Still hoping and praying.
