He can’t hold your case forever. So it was just a I-751 interview? Did you apply the N-400?

As noted, it is impossible (without there being a mistake) to approve the N-400 before the I-751. Successfully removing conditions is a requirement for your naturalization.

I'm assuming they had a joint ROC + naturalization interview. Because, by law, one cannot naturalize with conditional residence (with very limited exceptions).

https://www.uscis.gov/policy-manual/volume-12-part-d-chapter-2

Quote

B. Conditional Residence in the General Requirements (INA 316)

A conditional permanent resident (CPR) filing for naturalization under the general provision on the basis of his or her permanent resident status for five years [11] must have met all of the applicable requirements of the conditional residence provisions. [12] CPRs are not eligible for naturalization unless the conditions on their resident status have been removed because such CPRs have not been lawfully admitted for permanent residence in accordance with all applicable provisions of the INA. [13] Unless USCIS approves the applicant’s Petition to Remove Conditions on Residence (Form I-751), the applicant remains ineligible for naturalization. [14]

My N400 was approved without approval of I-751. So it is possible.

Interview in November 2018, RFE in January 2019, approved in June 2019. Hope this helps you.

Something is wrong there. It probably was approved. It might not show but it had to be approved. Or are you saying you were naturalized and everything but your I-751 is still pending?

When was your I-751 approved? I'm presuming it was done before or at the same time as the N-400. As noted by both law and policy, it would have been a mistake to have approved the N-400 with a pending I-751.

It has been almost 3 weeks,no update...

As others have said, expect your N-400 to be delayed until the ROC has been approved. USCIS has 120 days from interview to make a decision on the N-400. If I were you, I'd use this a way to nudge action on the ROC. After 30/60/90 days after your interview, ask your Congressional rep to follow-up on the ROC, as it appears to be delaying approval of your N-400.

I send my ROC almost 2 years ago
