Hello all need some help.

We are nearing the 90days of my wifes fiancee visa we have now been married for 2 months now. My question is I am still recovering from the trip to the Philippines financial wise. Must we file the papers within the 90days. I earn over the 125% needed to support but do not have the $500 yet to file the papers. We have the papers ready just waiting for a little extra to send them. What happens if we do not get the papers in before the 90days?

No, you do not need to file for AOS within the 90 days - if you've married within 90 days of your now-wife's arrival, you've complied with the conditions of the K-1 visa, and it doesn't matter if you file for AOS after the 90 days are up. However, it's a good idea to file sooner rather than later... particularly as the fees are increasing at the end of July - so if money is an issue now, you'll want to make sure you have everything ready by the end of July, as the fee increases are pretty hefty! :)

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

Nothing happens, you can file for AOS after the 90 day time limit. Its just until then, your wife will be in kind of a status limbo.

Fees will increase July 30th to $1010 (but EAD and AP are free while AOS is processing). I suggest you file before then.
