There is nothing to prevent the I-130 being applied or even approved. If you were inadmissible for 10 years, you can still have an approved I-130. You just won't be issued a visa until after the 10 years. So I-130 can be sent anytime.

I sort of assume you are on the correct track but also could be read he has just got out of jail.

 

Could be 9C and had to wait 10 years to be able to file a waiver, lots of ways this could be interpreted.

Yep, illegal presence more than 1 year, 10 year bar on entry. Just have the wife submit the I-130 ASAP. You could have done that years ago.
