Hey everyone,

 

We just received a Request for Initial Evidence on our I-485 Adjustment of Status application for my husband, who came over from the UK to the U.S. in April 2019 on a K1 visa. The notice said, "Submit a copy of the birth certificate or other primary birth record issued by the appropriate civil authority for the applicant. USCIS will only accept a long-form birth certificate, which lists at least one parent. It must contain one of the following: A legible seal, a legible stamp, a signature with a title containing the words secretary, registrar or births and deaths."

 

We originally submitted a photocopy of my boyfriends birth certificate with our I-485 application back in June 2019. It was a photocopy of a certified copy of his UK birth certificate. I did some research and this seems to be the long-form version.

 

We stored electronic copies of everything we submitted in our application, so I took a picture of the birth certificate scan and crossed out any identifying information. I attached it to this post. Of course the copy we submitted was much cleaner, this is just to give you an idea of the contents of his birth certificate.

 

Any ideas why this one might not have been accepted? Is it because the person who signed the birth certificate named themselves a "Deputy" and not a "registrar, secretary or births and deaths"?

Is what you quoted the entire contents of the RFI? 

For sure, the Deputy thing is not a reason for rejection.

I see year 2017, is that when the birth was registered? Usually USCIs sends RFIs for late registered BCs, they could have misplaced it as well.

Could be that you sent a photocopy of the certified copy that they don't like if they can't see the

It looks valid to me.

I would send it back with an explanation that it is a proper certified copy of his birth record that you received from the General Register Office of the United Kingdom (or wherever you ordered it) and the address. It has the crown seal at the top. And furthermore, if you ordered another from the government, it would be exactly the same.

 

Folks: 2017 is the year they ordered a copy of his birth record. The certification as a "true copy" of the birth record was signed off in 2017.

Just remember it is a photocopy of the certified copy not just the certified copy. You know they can be funny about that sometimes.

I also received a RFE today for this but I only sent the short copy so I've had to order a full. Does anyone know how long it will take after an RFE to see if its approved? Also does this mean that everything else I sent was correct?

I had an issue with my MC and could only conclude that either they lost it or could not see the raised seal on it as it was literally only an indentation in the document. 

My remedy was to darken the photocopy so the imprint of the seal could be detected in the photocopy. I can't see whether this applies to you as I cannot see a seal in your photograph but if it does it may be helpful to use my remedy.
