On both my NOA2 and packet 3 (received today!), the family name listed for my wife is her maiden name.
But in the 130, 130A we only used her new last name, her married name (apart from when asked about her previous names.)
The passport copy and birth certificate submitted with the application have her maiden name.
Her passport does not have and will not have her new married name, is not possible to change it, in Belgium women don't get the husband's last name.
(It's just not something Belgium allows its citizens to do, you keep your name for all your life, except for rare situations like if a child is adopted.)

 

Is it a problem that the NOA2 and packet 3 are using the old name?
Naturally we want to use her new married name.
I'm just a little worried that if I continue using her married name in the online DS-260, and in subsequent forms, it won't match up or something?
Should I inform them, or is this no issue whatsoever?

From what I understand, the name on the green card is the name that you 'have' when you enter the USA, correct?

And if you want to change the name to the married name, you have to do a AOS, which means you need to pay.

 

I thought the marriage certificate is proof that the name has changed, I read other users writing things which disagrees with what you say - I believe.

The Visa will be issued in the passport name.   We went thru this in reverse last year.   Applied in maiden name and then got a new passport while waiting for consulate appointment.

 

You two choices are:

Do a legal name change upon arrival in the US and pay the USCIS Fee to reissue (but she would still fly under her old passport unless Belgium will re-issue)

or wait until citizenship and do it for free.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Thank you. We'd rather have the name changed before the citizenship process (long wait). It's just a name, but it feels good to have the same last name. So ok, I will spend the $$$.

Ok I understand the flights need to be booke din the same name as the passport, no problem with me.
I don't want to wait until citizenship - so what is the process to do the name change? Just the regular name change that anyone does if they want to change their legal name from 'John' to 'Peter'?
