Hi guys. We applied for dcf philippines march 22 and got approved on april 23. Ir1 category. Wife my pass her medical already on August 2. Her interview is on the September 27th. Okie here my question regarding the i864 for non filing of tax and domicile. 1st. Non filing of tax. I have never work or even paid tax because i was here in the philippines since 2001 but i did go to the u.s for a vacation on 2016 to 2017. How do i do a non filing of tax letter? Oh i do also have a joint sponsor which is my brother. 2nd. Domicile. I'm currently here in the philippines and I understand i need to do a intent to re established domicile letter? I do have leasing agreement form were my name and my wife name and my mom and my brother name. My brother is the primary tenant he just move to the new apartment from previous apartment were he was since its too small to accommodate me and my wife. And i can also have my brother do letter stating that me and my wife can live with hime.

Did you work on the Philippines? If so - and it was about the minimum threshold to file - then you need to file those back tax returns. USCs must report worldwide income. If you did not work or earned below the filing threshold, then you can just mark that you did not file for those years and provide a reason on the I-864.

 

Keep in mind domicile is more than having a place to sleep. I suggest providing other evidence of intent to establish US domicile (moving cost quotes, job search / interview evidence, etc. There are some good examples in the NVC wiki on this website).

I'm also in the same exact situation as you, filing DCF as well. Born in America, moved to China in 2009, then I moved full-time to the Philippines in 2015. Married here on September 17, 2016.  I filed DCF with my wife at the Manila Embassy (I-130) on March 4th. That's over two years from my wedding, so that means I'm an IR1 category rather than CR1. Notice from USCIS received April 2nd. Filed DS-260 on April 22nd. Wife's Medical Exam at St. Luke's Clinic Extension today. In a very similar situation as you. 

 

Did not file taxes for a long long long time since being out of the US. Need to do something similar to you as well. Mother is my co-sponsor in Cali. Need to also establish domicile. I still have a bank account and credit card that I maintain in the States. Last visit was for a month in 2015. Would be moving to my mother's place to start settling back in Cali.

Ours is on the 27th. I think you will need a joint sponsor and a written explanation why you never filed tax and written explanation on domicile. I think is intent to re established domicile. Ill be doing those two also. Have you done yours?

Have NOT done that yet but I do have a written letter and income statements from my Mom in Cali that she will sponsor my wife and allow us to obviously live there, along with copies of her W4. I plan to write about how I moved to the PI to raise my son (born in 2017) and all. You're right.... I'm not sure what else I can see. I've been disconnected from the States for a while but this is my chance to go back and raise my family there. Are you in a similar situation? Also living here and filed DCF?

Kinda similar and yes we filed through dcf before it was removed. I live here in the philippines since 2001 and only went back to the u.s on 2016 to 2017 for a vacation. I nevered work or filed taxes since my parents were supporting me. My joint sponsor is my brother and we will be staying with him if every thing will worl out. Im kinda of having trouble trying to make a intent to re established domicile letter.

Damn, lived here full time since 2015. First visit was back in 2009. Only went to Cali and Hawaii for a month each visit in 2013 and 2015, that's it. Never worked or paid taxes either since my folks were also supporting me as well. Joint sponsor is my Mom. Also having trouble with this letter since I'm not sure if they will buy the "Raising my son" excuse as he's only two years old now. Married in this country back in 2016 too. We are similar... I'm born in San Francisco of all places. 

 

Gonna have a real hard reality adjustment if I do go back to Cali...... I'm so used to Filipino completely lawlessness and random enforcement of any rules, no common sense type , out of stock, etc. I'm basically used to seeing poverty everywhere and it doesn't faze me at all now.

From what i know about the domicile is that you would need to explain how will you intent to re established domicile in the u.s like a letter from you're parents that you could stay with them. A job offer or probably an explanation letter. Yea feel the same way also but you gotta work because there ain't no job here in the philippines unless you own a business

So how would you explain it? We both don't pay taxes or work or show income. Then again, my other friend did DCF back in 2015 and he didn't work either but made up a fake job offer (his other friend "vouched") as a marketing position and showed 30k usd in a bank account. And it actually worked and he's been back there ever since with his wife, back then he probably lived about three years in the PI or so. On top of his mother being his joint sponsor.

 

Would they buy a "raising my son" excuse? How strict are they these days? You're right, looks better if I can show them some future prospect of employment. Now I wished I had picked a later date in September, didn't really think this out on paper as they will ask about my "work" but I just receive income from my folks anyway. I wouldn't try what you're friend did because I don't think that will work anymore. I think writing a letter of intent to re established domicile would help just be honest in the letter. I was born here in the philippines grew up in the us then came home here. Im a dual citizen.

By the way what's you're template for you're domicile and non filing of tax?

Did you ever figure out what to write to explain all this? How are you preparing for the US Visa interview?

Honestly not yet but if you have Facebook and messenger there's this guy that might be able to help with you're situation. Type lovevisalife on Facebook its a visa group where you can question and get answers from followers who went through the entire visa process
