Unfortunately .. I wasn't well aware of the difference either until I was well into the process. For my sons sake .. in hindsight .. the K3 probably would have been the better way to go ...

In hindsight... I wish I'd gone with a K3 too, for other reasons other than the AP.

But as mrsserendipity reminds me, I'm just happy that I'll get to be with Bee at the end of the road. :)

This may sound a little strange to you all, but WHY would you have chosen to do the K3 instead of the K1? In my understanding it takes a lot longer doesn't it?

Not all that much longer, maybe a couple of weeks extra since you first have to file for the I-130 and then on receipt of your NOA1 you have to include a copy of that along with your I-129f petition.

If you look at my timeline mine took 16 days extra since I had to file the I-130 first

Longer, maybe, but not substantially. Bee and I actually started this process by filing in a panic since we'd looked at the USCIS Case Progress page and thought "Holy $&*#, 9 months? We better get this process started!" Turns out that, ah, it took much, much, much faster than we thought it would be. *awkward cough*

Combined with both sides suddenly demanding that we have a formal wedding on their respective turfs, monetary concerns, my sister's graduation next year vs. AP, etc. for us it would have been much more feasible if we'd filed K3.

However, I'm eternally grateful for how fast it's been. :D

To the USC/Canadian couples: do you find it utterly ridiculous that we are required to file for the AP document? As a Canadian citizen you automatically have a visitor's visa to the US....UNTIL you activate your K1, now you have to ask for permission to return (Advance Parole)??

That makes NO SENSE to us, and Doug, who is always indignant about injustice, wants to know HOW TO CHANGE THE REQUIREMENT....I know....but I have to love his enthusiasm, and honour his request to ask....does anyone understand WHY or WHO to lobby against? He wants to start a petition for change, bless his heart..... :blush:

I guess he could start by emailing his senator or congressperson. Canada *IS* another country, regardless of its position geographically north of the United States. Travel to and from Canada is much like any other travel. By air a passport is already required and by 2008 a passport will be required for land and sea travel. I guess it's like this: once you activate the K1 its with the assumption that you are intending to immigrate and someday become a citizen. Therefore the USCIS expects you to follow the regulations they have for travel outside the States while you are adjusting your status to permanent residence. See where I'm going with this? Hope it made some sense. :)

I guess they figure, too bad that you still have family in the country you are from. Who cares about them eh?

I don't think AP is any more ridiculous than the rest of the process for Canadians. The number of times my mom thought I was making up this whole process because "can't he just drive down here whenever and you can get married".... But it's a different country, even though it's one that has eased tourist restrictions.

I wouldn't sign a petition, and I wouldn't think your odds are great on easing anything remotely related to border security.

Exactly, Joe.....I brought this topic up as a discussion starter, but like everything else, realizing change wasn't feasible....so many of us just keep shelling out the bucks so "we can be together" without questioning it....I know, why question if you can't change...and it's "worth it" to be together, guess I just needed to vent to someone who understood :(

I would consider it a blessing that you get the visitor's VISA so easily. I wish my British fiance could come over and visit any time he wanted.

To the USC/Canadian couples: do you find it utterly ridiculous that we are required to file for the AP document? As a Canadian citizen you automatically have a visitor's visa to the US....UNTIL you activate your K1, now you have to ask for permission to return (Advance Parole)??

That makes NO SENSE to us, and Doug, who is always indignant about injustice, wants to know HOW TO CHANGE THE REQUIREMENT....I know....but I have to love his enthusiasm, and honour his request to ask....does anyone understand WHY or WHO to lobby against? Your British fiance can come over here with just as much ease as the Canadians can.... its called the VWP... all he/she need to bring is evidence that they intend to return to the UK before the I-94w expires.... there are 1000's of fiances come over on vaccation while they wait for their K1....

Well the whole idea of this is that yes Canadians can come and visit without any special visas. They are at the border proving that they are returning back to Canada by stating who and how long verbally they will be in the US to the border guards. This assues the US that the Canadian is only visiting and not residing illegally in the US which of course you cannot do without proper visas.

So down the road you get married to a USC and now you are residing in the US. So in order to prove to the US customs that you are living in the US and are allowed to live there, you use the AP document. Since you are no longer just 'visiting' for a short duration.

Canadians who want to visit the US for longer then a couple of months (can't recall how many) actually must get a visitors B2 visa to remain in the US that long. So yes you still need visas to enter if you are going to visit for a certain amount of time.

So it's not a ridiculous thing at all, it's a good safety measure to show that you are indeed living in the US legally. Now of course people have claimed they are visiting the US and outright lied and are living in the US illegally, but that can be risky. After all we don't want the illegal immigrants in the in US, only legal ones.

I hope that clears things up of why the AP document is necessary and why anyone regarless of nationality needs one. It's the basic difference between a resident and visitor and proof to show you are legally allowed to be there...
