To the USC/Canadian couples: do you find it utterly ridiculous that we are required to file for the AP document? As a Canadian citizen you automatically have a visitor's visa to the US....UNTIL you activate your K1, now you have to ask for permission to return (Advance Parole)??

That makes NO SENSE to us, and Doug, who is always indignant about injustice, wants to know HOW TO CHANGE THE REQUIREMENT....I know....but I have to love his enthusiasm, and honour his request to ask....does anyone understand WHY or WHO to lobby against? He wants to start a petition for change, bless his heart.....:blush:

Eventually everyone crossing the border in either direction will be required to have a passport, which sucks also.

The rule is that AOS is considered to be abandoned if leaving the country without AP, this wont matter much more, after July 30, AOS will include AP and EAD.

Feeling it.. totally.. it's a tough tough pill to swallow.. I think Zyggy has said more than once, we don't often realize that its a real honest to goodness border between Canada & US and it's times like this we realize it's complexity (forgive me for paraphrasing).

That being said.. from what I've seen Generally (and I mean generally) they seem to transfer more of us to CSC and don't make us go through for interviews.. so i dunno it might balance it a bit? I was 3 months without flexability to go to Canada.. it was relatively painless for us..

I guess he could start by emailing his senator or congressperson. Canada *IS* another country, regardless of its position geographically north of the United States. Travel to and from Canada is much like any other travel. By air a passport is already required and by 2008 a passport will be required for land and sea travel. I guess it's like this: once you activate the K1 its with the assumption that you are intending to immigrate and someday become a citizen. Therefore the USCIS expects you to follow the regulations they have for travel outside the States while you are adjusting your status to permanent residence. See where I'm going with this? Hope it made some sense. :)

If travel too and from is a big concern why not marry north of the border and file for K-3? K-3 allows travel and is a multi entry visa, no AP required.

I never expected any special treatment to be able to enter the USA. We are seperate countries!! And one does have other options, such as a K3 or cr-1.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

We should have, but the attorney we fired convinced Doug it was better to go K-1 and we're already almost thru it (Packet 3 rec'd yesterday)

We don't expect any "special treatment" either; however, Canadians are able to enter the US on an "automatic" Visitor's Visa...if I understand that correctly, it means Canadians are already different than other immigrants in that they don't need to APPLY for a Visitor's Visa....that's the mindset Doug is in as far as requiring Advance Parole.

I don't think AP is any more ridiculous than the rest of the process for Canadians. The number of times my mom thought I was making up this whole process because "can't he just drive down here whenever and you can get married".... But it's a different country, even though it's one that has eased tourist restrictions.

I wouldn't sign a petition, and I wouldn't think your odds are great on easing anything remotely related to border security.

This is it in a nutshell Amanda...Canadians. This is the United States and the regulations regarding travel are different. I'm sorry Doug is of the mindset that this is ridiculous, but every one of us who came on a K1 have had to use AP if travel was important before GC approval. If it was just travel and no visa or adjustment involved, there would be no AP involved and one could just cross the border with the proper passport/documentation. Once you step foot through the immigration portal everything changes. That's just the way it is.

Yeah, yeah....Doug had a lawyer tell him to just get married when we wanted and go thru the I130, then the attorney his boss referred told him he might jeopardize his job if he did (he's driving truck at the moment), so we listened to the second guy.....then found VJ....then fired the second guy :blink::blink::wacko:

Hindsight at its finest, sigh.

I don't know if I'd find it ridiculous for us USC/Canadian couples. The way I see it, Canada is still a different country from the US, and I don't expect a great deal more than what we have right now. Despite the fact that Canadians do get a waiver for traveling visas and school, immigration is a completely different story.
