So...I do not know how I feel about this...

Filed September 2019 with my back then husband. We separated February 2020 and our divorce was finalized one month ago. I hired an immigration lawyer to help me make the changes. TODAY I check the app and it says New Card is Being Produced. Now I should be happy and everything but I am most certain they approved it under the belief that we are still married. I reached out to my lawyer to see what she thinks we need to do but I literally opened the app, refreshed it and went WHAT?! And started crying....Not sure if I should be happy or concerned :(

Did your lawyer send letter to USCIS for changing to waiver yet? You can look at the approval letter to see they approved your case under jointly or waiver. If they did under married, they will ask again when you apply citizenship and i don't think it will be easier for you

We were waiting on the stamped divorce decree and we were going to send the documents again. So I am sure they approved it under the belief that I was still married. I am not going to wait until I apply for citizenship. I will get this fixed and hopefully they won't change their mind.

I already spoke to my lawyer and she said that we should still send in the affidavit explaining what happened. If that means the case will be re-opened, then I am fine with that. I was not expecting to be approved in 12 months.

My personal, non-lawyer, opinion...

We apply to remove conditions if you've been married for at least 2yrs. Looks like you were married for more than 2yrs then you got divorced just before the 3yr mark. So you met the criteria to get the 10yr card.

The condition isn't, stay married until approval.

Based on that reasoning, I would happily keep my card, and wait for citizenship application in 5yrs.

There are also many people who get divorced before getting their citizenship, I don't believe they have to constantly update uscis on their marriage/divorce status.

@Mwar thank you for your non-lawyer opinion, it makes sense but I just don't want to run into any trouble once the time comes to apply for citizenship :)

Absolutely do not file a N400 until you are a permanent resident for five solid years, as you can’t use married to a US citizen for reason for Naturalization.

I don’t think you have anything to worry about but if you are concerned you can always open up an info pass appointment and speak to them in person.

Yes, I understand that now that I am single, I have to wait 5 years to apply for citizenship. So sometime in August of 2022 since I got my conditional in November 2017. I won't do anything and I will just do what my lawyer tells me to do. I still need to get my hands on the certified divorce decree.

Thank you for your optimism! I too think that I don't have anything to worry but you never know.

I got a text message from USCIS that there is an update on my account.

I thought my application was approved but it turned out to be a “name update”!!

Any idea what that means? I didn’t request a name change/update

What was the average time frame that people wait for the message that they are "scheduled for interview" to actually receiving the interview? My case status changed to "You are ready to be scheduled for interview" as of June 3rd 2020 but I still have received nothing in the mail....

Really depends on your local field office and how they operate right now.
mine has been ready for an interview for about 3 months as well in Albany and I haven’t heard anything else. We could hear something tomorrow, or in a year from now...

You are right.

I was scheduled for interview in the month of June, I got so excited. While waiting, I got two emails at the same time; one wrote, my interview had been cancelled, another wrote it was rescheduled.

Right now, I am just waiting on my window to open next month so as to apply for N400.
