In my opinion, this would lead to a few thousand dollars spent for an attorney to say, "Sorry, your K-1 road is dead.......but for another $2000-$5000, I can help you with a CR-1 visa.......

Agreed.  Just like congress cannot generally affect an outcome of a state department decision, nor can an attorney.

I think you might be wrong about that.  I think the CO had doubts about something.....it could be the way your fiance answered some of the questions..

But why would you chance another K-1?  You have another year of waiting ahead of you.......for an inferior K-1 visa?

Just my opinion......feel free to blast away.....

I think my fiance did stumble with a few of the questions as well. I know there were two questions that he stated he did not know the answer to. Yes - that could also be the reason, but why not just deny the visa then and there? Why request additional documentation and then wait two months to deny us?

If we go this route I will be at the interview come hell or high water AND we will be sure to review EVERY possible sample question.

We are so tired of being away from each other ( I know - we all are) and another year just seems like an eternity. Also, my ovaries aren't getting any younger!! LOL

Be aware that the day of interview the consular office dont review evidence, you need send all your evidence on your packet to uscis, the same packet will be send to Santo Domingo embassy, many people send a packet without many evidence thinking that the day of the interview the consular officer will review new evidences ,

they dont care if you have a bag or suitcase with evidences, the day of interview they basically take the decision base on your packet and what is on it, and also base in some questions.

Good point! We did have all required evidence and documentation in the original I-129F packet that was sent to USCIS. We simply added MORE evidence for the interview.

You are making a big assumption that the reason it was denied was because you weren't there. Something seems off about this case. Are you sure your fiance has given you the WHOLE story as well as his background.

Seems pretty foolish to go down the K1 again...

Yes, I'm sure.

I haven't decided which way to go yet. Still weighing the options out. Neither one is 100%.

If I were you I'd seriously consider what the more senior people on the forum are recommending :)

I admit that the utility bill is not necessarily a joint asset, although mine has a deposit associated with it, which is an asset.  As assets are shared, so is debt.  A utility bill, among other things, can show the mingling of two lives.  The fact that the officer is "requiring" such evidence before the marriage has even taken place is even more ridiculous than providing such evidence after the fact.

Hardly ridiculous. As noted by several people (myself included) it was most likely asked for because OPs fiancé messed up the interview somehow. Possibly misspoke due to language barrier or was stressed and got a few small inconcequential details wrong that added up to a larger whole. At that point it’s up the the CO to outright deny or ask for more information which could prove the “wrong answers means it’s a fake/for immigration only relationship” assumption wrong. OP and her fiancé couldn’t/didn’t provide that which is how we ended up with this thread.

Don’t know about other couples but as soon as my husband and I decided we would marry, he comingling began. We have less “new” evidence post marriage than stuff that we did before marriage, so it’s hardly unrealistic to expect a couple who intend to spend their lives together to have SOME evidence of their co-mingled lives beyond photos, family communication and some travel together - all of which are things that can show a “relationship” between totally platonic friends as well as romantic life partners.

Yes, but it would also make no sense.  Think about it...why would you share a utility bill if you neither lived together nor were married.  No point in trying to force commingling of finances when it isn't natural.

Everything I read prior to filing for the K1 said to not even have ANY APPEARANCE of even seeming to be married. They deny you simply for the reason alone - if it APPEARS you are already married. Why on EARTH would I think it was a good idea to co anything???

It is very common in the DR to refer to each other as husband and wife without being legally married.

If you even refer to your partner as husband or wife they can deny you.
