No. It’s foolproof evidence that your uterus works.

My husband and I can’t have children. Are you saying our marriage is less genuine because I had emergency surgery that required the removal of certain reproductive organs? Ridiculous.

I’d file sooner, rather than later, if I were you. Every minute you don’t file you are accruing unlawful presence. Whilst overstay for spouses of USCs is forgiven, the forgiveness only takes effect once you have the NOA1 for AOS. Up until that point, you are just as illegal - and just as deportable- as the next person.

Whelp I'm sorry if what I said triggered anything. And i'm sorry you couldn't have kids but that is not what I meant when I wrote that; I said it is ONE proof, not the only proof. I have other evidence.

I also know "I am just as illegal" and "deportable" until I file my papers, ma'am. Hence, the reason I'm soliciting help from people here who have  ( more )experienced than I am. I don't need to explain as well why I didn't file it sooner.

Yes, excellent proof... but I was leaning more along the lines of I’d be terrified of screwing it up and getting deported having to leave my kids behind, when I said given kids involved ☺️

thank you.

Gathering supportive documents all depends with your pace.

My suggestion- download each form together with its instructions from USCIS website. The instructions also provide guidance on how to fill the form.

Upon downloading instructions and for each form, look at the area that talks about supportive documents/ documents that should accompany that particular form. Read through that section and decipher for yourself how many you have handy and how many you can organize to get. Simple...remember, any document like birth certificate in foreign language has to be translated.  You haven't filled your timeline. So i can't tell your native language.

Will do that today. Also, I'm from the Philippines.

Hi, thank you. I read somewhere that having kids together is one fool proof evidence of a bonafide marriage, not saying that we had kids just for the sake of getting a GC ( that's a bit of commitment ) but I should say the overstaying for 6 yrs is what's making me get a consultation at least. I do want to save as much as I know filing fees are expensive ...

Just for some added clarification, I thing the "fool proof" comment is what came off wrong. The reason being is that we have seen people come in here wanting to immediately impregnate someone they just met because they think it will guarantee a visa. Although pregnancy is a wonderful thing between two loving people, it can and does get exploited. A woman can get pregnant from a one night stand or by someone she has no emotional interest in. So you can see how some people who are in fraudulent relationship try to use pregnancy as an added benefit.

Hope this helps.

Hahahah I don't think @JFH was offended or meant to be offensive. She was just answering a question with a question, which is another way of teaching.

Good luck. Incase you need help, VJ is here. All forms that you need are in the guide.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

I'll concur that a lawyer is not necessary, but I would make sure to go over all your paperwork with a fine tooth comb so to speak to make sure you have everything that is asked for, and that everything is filled out correctly.

Essentially, you want to make sure that you do no become a blip on the radar and then have something go horribly wrong because of a paperwork error...  Otherwise, this should be straight forward; somewhat similar to what I went through, for other reasons...

Good luck!

We also see people who come here thinking that because they have children together no other evidence is necessary or that their case is watertight. I was pointing out that you need a lot more various forms of quality evidence than just a child or two.

I think “quality not quantity” cannot be emphasized enough in this game.

Regarding a lawyer... I filled out all the paperwork myself for the I-130, I-485, and I-765 and then had an immigration attorney review it, which I believe was a couple hundred dollars (much less than having the lawyer submit it all for me). The session was very helpful to me, as the lawyer answered all of the questions I had while preparing the documents. She also made a few recommendations about the order of submitting everything. Overall, I felt at ease that a professional reviewed my paperwork and that there weren't any major concerns. Not sure if this is a common service or not, but something to consider if you decide to not go with a lawyer.
