Hi, I would like sum more information as to how to proceed with filing immigration forms. My boyfriend and I have been dating for two years, iv visited him in usa, returned home and came for visiting again. We wanted to spend more time together so i applied for b2 visa extension. My application is currently pending and iv done the biomatrics. He has proposed and we've gotten married. Now we want to file adjustment of status for. Now the question is which surname do i use, iv no other proof except marriage certificate. Also I need to travel back to my country to sort out my things over there but should i wait till iv received approval of green card? Also what supporting documents can we add for our marriage since its so sudden? Any advice will be highly appreciated.

Depending on the state/county law, that might be sufficient proof of your new married name. It depends.

Wait for either Advance Parole or the Green Card.

Your screen name on here is German. If you're indeed German you would have to go to Germany with your spouse to change everything to your married name. You'd bring your marriage certificate with apostille and translations. You can't change your name without your spouse in Germany. 

 

If you're not German (why would you use a German name?) then disregard. 

 

You can go ahead with AOS just fine with your new married name. Your EAD and Green card will be issued in your married name. If you travel, bring your marriage certificate along in case there are any questions about the different names. When booking flights, you'll book them in your passport name.

I wasn't aware one had to be German to pick a German user name in a forum. 

What if they are from Austria, or Switzerland? Or Argentina?  Could be their last name, or they could be a fan of the composer, who knows?

 

Strauss, the answer might depend on your country of citizenship, and what was filled so far - please complete your timeline so you get accurate answers.  

 

Also, when do you need to go back? Adjustment of status prevents you from travelling outside the US, and coming back, without abandoning the process, before you receive AP or your green card.  If you need to go back soon, you can still apply for a spousal visa.

Thank you all for the information. I should've mentioned im from Namibia. Im not traveling until January 2020, and im planning on submitting documents by end of this week. My husband and I just needed sum clarification as to which surname to use and my legal status in the US.
